Terms and Conditions for Mobile Banking Service
These terms and conditions (“Terms and Conditions/ T&Cs”) shall be applicable to the Customer(s) (defined hereinafter) availing the MyBank Facility (defined hereinafter) of RBL Bank Limited (“RBL Bank”).
The T&Cs shall be in addition to and not in derogation to the terms and conditions applicable to Deposit Account, account variant other relevant terms and conditions offered by RBL Bank (“Primary Terms and Conditions”) and available on RBL Bank’s Website. In case of any inconsistency between the Primary Terms and Conditions and these T&Cs, these T&Cs shall prevail. All capitalised terms used but not defined herein shall have their respective meaning as ascribed under the Primary Terms and Conditions.
1. Definitions:
The following words and phrases shall have the meanings as set below unless the context indicated otherwise:
- “Account” shall mean an individual holding a savings and/or current account with RBL Bank.
- "Alert(s)" means the customised messages sent to the Registered Customer Number as an SMS in response to the Triggers set by the Customer.
- “Application” shall mean RBL Bank’s MyBank application which will be downloaded onto the Device of the Customer.
- “Applicable Law(s)” shall mean any rule, law and/or regulation having force of law in India including notifications, circulars, orders by statutory, regulatory, judicial or quasi-judicial bodies or the like, and all the regulations, notification, circulars, guidelines, directive and all other statutory requirements issued by the regulators including but not limited to RBI, NPCI and/ or any competent authority in each case, as may be applicable.
- “Authority” shall mean rules, regulations, directives, orders, circulars, guidelines, notifications, policy directions etc. issued by RBI, NPCI, central or state government, municipality, judicial, quasi-judicial or any tribunal.
- “CIF” shall mean Customer Information File.
- “Customer” shall mean a resident of India who is the sole or first holder of Account and who has availed the MyBank Facility.
- “Customer ID” or “Customer Identification” shall mean a username assigned to the Customer by RBL Bank for availing the Facility(ies) via MyBank.
- “Device” shall mean any electronic device including but not limited to computer, laptop, mobile phone, tablet that enables Customer(s) to access MyBank and use the Facility(ies).
- “Facility” shall refer to the variety of mobile banking services being offered to the Customer(s) including but not limited to balance enquiry, statement of account, cheque-book related requests, personal account information, transfer of funds, deposits, card services, investments, and any other facilities as RBL Bank may decide to provide, by itself or through appointed service provider(s) and/or third party(ies), from time to time to its Customer(s) through MyBank.
- “GPRS” shall mean the General Packet Radio Service.
- “GSTIN” means the Goods and Services Identification Number.
- “INR” means Indian Rupee.
- “Instructions” shall mean instructions given by the Customer for operation in the Account from time to time via MyBank.
- “MPIN” shall mean MyBank PIN which is a four-six digits passcode used to authenticate transactions and verify identity on MyBank.
- “MyBank” shall refer to the mobile banking Application of RBL Bank.
- “NPCI” means the National Payment Corporation of India.
- “NRI” means Non-Resident Indian.
- “Ombudsman” shall have the same meaning as defined under Reserve Bank of India’s Banking Ombudsman Scheme, 2021.
- “Personal Information” shall have the meaning ascribed to such term in the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, or any other applicable law, as amended from time to time, of the Customer(s), which, either directly or indirectly, in combination with other information available or likely to be available with RBL Bank is capable of identifying such person and which consists of information relating to:
- passwords;
- financial information such as credit card details;
- physical, physiological and mental health condition;
- sexual orientation;
- medical records and history;
- biometric information;
- any detail relating to the above types of data provided to a body corporate for providing services;
- any information received under any of the above heads by a body corporate for processing or storing under a lawful contract or otherwise.
- “PIN” shall mean Personal Identification Number.
- “Privacy Policy” shall have the meaning as ascribed on RBL Bank’s Website.
- “RBL Bank’s Website” means www.rblbank.com.
- “Registered Customer Number” is the mobile number which the Customer(s) has registered with RBL Bank for availing MyBank.
- “SIM” shall mean Subscriber Identity Module.
- “SMS” shall mean the Short Message Service.
- "Triggers" shall mean the customised triggers that are required to be set by the Customer with RBL Bank, which shall enable RBL Bank to send the Alert(s) relating to his Account(s) on the Registered Customer Number.
2. Interpretation:
- All references to singular include plural and vice versa and the word “includes” should be construed as “without limitation”.
- Words importing any gender include the other gender.
- Reference to any statute, ordinance or other law includes all regulations and other instruments and all consolidations, amendments, re-enactments or replacements for the time being in force.
- All headings, bold typing and italics (if any) have been inserted for convenience of reference only and do not define limit or affect the meaning or interpretation of these T&Cs.
- Reference to any law or legislation, regulation, rule shall mean, applicable, constitution, statute, law, rule, regulation, ordinance, judgment, order, decree, authorisation, or any published directive, guideline, notice, requirement or governmental restriction, having the force of law in any jurisdiction and include laws as amended from time to time.
3. Eligibility for Using MyBank:
- The Customer(s) hereby agrees and undertakes that the Customer shall use MyBank only if the Customer(s) fulfils the eligibility as given below:
- The Customer(s) is an individual;
- The Customer(s) is a major or is a guardian of minor;
- The Customer(s) is of sound mind, solvent and competent to contract;
- The Customer(s) is a resident of India;
- The Customer(s) is a non-resident Indian (NRI) or Person of Indian origin (PIO) as defined in Foreign Exchange Management Act, 1999 (FEMA).
- The Facility shall be made available to the Customer subject to the condition that the Customer downloads the Application and sets his/her MPIN. This Facility shall be made available only to the Customers satisfying the eligibility criteria and shall be provided at the sole discretion of RBL Bank and may be discontinued by RBL Bank at any time, with prior notice to the Customer(s).
- The Customer desirous of using the Facility(ies) through MyBank should be either a sole Account holder or authorised to act independently. In case of joint Account(s), the written mandate of other account holders authorising the Customer to use the Facility(ies) would be required. All or any transactions arising from the use of the Facility in the joint account shall be binding on all the joint account holders, jointly and severally. An Account in the name of the minor, in which a minor is a joint account holder or any Account where the mode of operation is joint, is not eligible for the Facility.
4. Applicability of Terms and Conditions and Authority to RBL Bank:
- By using MyBank, the Customer(s) thereby agree and consent to these Terms and Conditions, which may be modified/altered/revised at the sole discretion of RBL Bank from time to time, forming a binding contract between the Customer and RBL Bank. By applying and opting in for MyBank, the Customer agrees and confirms to have accepted:
- the T&Cs applicable to the Customer for availing the Facilities being offered by RBL Bank through MyBank;
- the Privacy Policy of RBL Bank applicable to the Customer(s) for availing the Facilities;
- any other Account/product/service/offer related specific terms and conditions as applicable.
- The Customer(s) agrees that RBL Bank may modify the process for authentication, registration and/or verification of the Customer, at any time, at its sole discretion.
- No act, delay or omission by RBL Bank shall affect its rights, powers and remedies under these T&Cs and Primary Terms and Conditions available on RBL Bank’s Website.
- RBL Bank’s own record or log of transactions maintained through RBL Bank’s systems shall be accepted as conclusive and binding for all purposes.
5. Facility:
- The Customer(s) agrees and accepts that RBL Bank reserves the right to provide only such Facility(ies) as RBL Bank may at its discretion permit from time to time.
- RBL Bank may also inform/update the availability/non-availability of any particular Facility, at its sole discretion. Any change in the business rules of any of the processes will be notified on RBL Bank’s website, which will be construed as sufficient notice to the Customer.
- The Customer(s) hereby agrees that RBL Bank may at any time, without notice to the Customer(s), modify, discontinue or make additions/deletions to the Facility(ies) offered to the Customer(s).
- The Customer(s) agrees that he/she shall not hold RBL Bank responsible for:
- not responding to the queries of/ information sought by the Customer(s);
- declining a Customer’s request due to not meeting the eligibility criteria for using the Facility(ies) as outlined in these T&Cs;
- not providing a response to the satisfaction of the Customer(s) or not processing any request of the Customer(s);
- in case a message sent by the Customer(s) is not received at RBL Bank’s end or the message sent by the Customer(s) is not in the format as required by RBL Bank or does not fall under the Facility(ies) being offered by RBL Bank at the time or RBL Bank does not receive such a message for any reasons including but not limited to technical reasons;
- In an event RBL Bank permits Facility in the nature of a financial transaction , the Customer agrees that such a Facility shall be subject to statutory/ regulatory limits and/or any limits that may be imposed by RBL Bank, from time to time, at its sole discretion and the Customer hereby specifically authorizes and consents to debit/credit the Account(s) to undertake and complete the Facility requested.
6. Availability and Disclosure:
- Section 3 of Information Technology Act, 2000 prescribes the procedure for authentication of electronic records, which states that a subscriber may authenticate an electronic record by affixing his digital signature and Section 5 provides legal recognition to digital signature for authentication of electronic records. However, RBL Bank has adopted the mode of authentication of the Customer(s) by means of verification of the mobile phone number and/or through verification of debit card PIN allotted by RBL Bank to the Customer or through any other mode of verification as may be stipulated at the discretion of RBL Bank, which are not recognized under Information Technology Act, 2000 for authentication of electronic records. The unauthorized access and/or use of aforementioned modes of authentication can raise a risk to the security of the Account(s) of the Customer.
- The Customer(s) shall ensure maintenance of complete confidentiality, secrecy and protection of the authentication parameters such as the Registered Customer Number and debit/ credit card PIN allotted to the Customer(s) or any other mode of verification as may be stipulated at the discretion of RBL Bank.
- The Customer shall not disclose and not respond to any unauthorized SMS/ email/ phone call wherein such details have been asked for. RBL Bank shall, in no manner whatsoever be held responsible or liable, if the Customer incurs any loss as a result of the Registered Customer Number and/or debit/credit card PIN and/or any other mode of verification as prescribed by RBL Bank from time to time being disclosed/ shared by the Customer with any unauthorized persons or in any other manner whereby the security of any of the modes of verification is compromised.
- RBL Bank shall endeavour to provide to the Customer through MyBank, such Facilities as RBL Bank may decide from time to time. RBL Bank reserves the right to decide what Facilities may be offered to a Customer and may differ from Customer to Customer. RBL Bank may also vary the Facilities offered through MyBank at its sole discretion.
- The Facility(ies) are made available to the Customer at their request, at the sole discretion of RBL Bank and may be discontinued by RBL Bank at any time, without notice. The access of the Customer to the Facility(ies) shall be permitted to only those Customer availing the Facilities through the Registered Customer Number.
- The Customer(s) understand that since the transactions are instantaneous in nature, the reversal of the same is not feasible. The Customer(s) understand that no stop payment requests submitted by the Customers would be accepted by RBL Bank.
- RBL Bank shall endeavour to carry out the Instructions of the Customer promptly, provided that the Bank, shall not be responsible for the delay in carrying out such instructions due to any reason whatsoever, including, but not limited to, failure of operational system or any requirement of law or RBL Bank’s internal policies.
7. General Business Rules Governing MyBank Facilities:
- The daily upper ceiling under the Facility, per Customer shall be as follows:

RBL Bank reserves the right to modify the limits mentioned in the table above and provide prior intimation to the Customer(s). - Entering the wrong MPIN thrice will block the Facility and the Customer will have to re-register to avail the Facility(ies) as per the procedure laid down by RBL Bank.
- The Customer is responsible for ensuring that the correct account number of the beneficiary is selected. The transfer of credit will be processed strictly based on the beneficiary’s account number and no other particular or information related to the beneficiary will be considered for validation. In an event the account number of the beneficiary provided by the Customer is incorrect, the Customer must delete beneficiary and re-add the beneficiary with the correct account details using the “Add Payee” option.
- In the case of a joint account where mode of operation is “Either or Survivor” any of the joint account holders can use the Facility. The transactions in such accounts shall be binding on all the joint account holders, jointly and severally. The Customers are bound to advise RBL Bank separately, of any change in the mode of operation in an Account and get it affected for necessary modifications to the Application. Accounts where mode of operation is “joint” as also accounts in the name of minor or where minor is a joint account holder are not eligible for the Facility.
- RBL Bank reserves the right to reject a Customer’s request for the Facility or to reject any transaction/request, if it finds that the request sent by the Customer is not as per the requirements stipulated by RBL Bank for availing the Facility without assigning any reasons.
- The services offered under the Facility will be automatically terminated if the primary account linked for MyBank Facility is closed. RBL Bank may also terminate or suspend the services under the Facility without prior notice in an event the Customer has violated the terms and conditions laid down by RBL Bank or on the death of the Customer when brought to the notice of RBL Bank.
8. Usage of Facility:
By accepting the terms and conditions on the Device while registering for the Facility, the Customer:
- Agrees to use MyBank or financial and non-financial transactions offered by RBL Bank from time to time.
- Also irrevocably authorizes RBL Bank to debit the Accounts which have been enabled for mobile banking services for all transactions/services undertaken.
- Authorizes RBL Bank to map the account number, Customer ID and Registered Customer Number for the smooth operation of MyBank offered by RBL Bank and to preserve the mapping record in its own server or server of any other third party and to use such data at its discretion for providing/enhancing further banking/ technology products that it may offer.
- Agrees that the Customer is aware and accepts that the Facility offered by RBL Bank via MyBank will enable the Customer to transact using MPIN within the limit prescribed by RBL Bank and will be deemed as bonafide transaction.
- Agrees that the transactions originated using the mobile phones are non-retractable as these are instantaneous/real time.
- Understands and explicitly agrees that RBL Bank has the absolute and unfettered right to revise the prescribed ceilings from time to time which will be binding upon the Customer.
- Agrees to use the facility on a mobile phone properly and validly registered in his/her name only with the Mobile Service Provider and undertakes to use the Facility only through Mobile Phone Number which has been used to register for the Facility.
9. Records:
All records of RBL Bank generated by the transactions arising out of use of the Facility(ies) via MyBank, including the time of the transaction recorded shall be conclusive proof of the genuineness and accuracy of the transactions undertaken by the Customer and can be used as evidence in any proceeding in the courts of law in Mumbai.
10. Others:
- The Customer shall be required to acquaint himself/herself with the process for using the Facility and that the Customer shall be solely responsible for any error made while using the Facility.
- The Instructions of the Customer shall be effected only after authentication the Customer’s ID and use of MPIN or through any other mode of verification as may be stipulated at the discretion of RBL Bank including Biometrics Services.
- While it shall be the endeavour of RBL Bank to carry out the Instructions received from the Customer(s) promptly, it shall not be responsible for the delay/ failure in carrying out the Instructions due to any reasons whatsoever including failure of operational system or due to any requirement of law. The Customer expressly authorizes RBL Bank to access his/her account information required for offering the services under the Facility and to share the information regarding his/ her accounts with the service provider/ third party as may be required to provide the services under the Facility.
- The transactional details will be recorded by RBL Bank, and these records will be regarded as conclusive proof of the authenticity and accuracy of transactions.
- The Customer hereby authorizes RBL Bank or its agents to send promotional messages including the products of RBL Bank, greetings or any other messages RBL Bank may consider from time to time.
- The Customer understands that RBL Bank may send “rejection” or “cannot process”’ the request messages for the service request(s) sent by the Customer which could not be executed for any reason.
- The Customer expressly authorizes RBL Bank to carry out all requests/ transactions purporting to have been received from the Customer’s Device and authenticated with the Customer’s MPIN. In the case of payment facilities like fund transfer, mobile top up, bill payment, etc, the Customer shall be deemed to have expressly authorised RBL Bank to make the payment when a request is received from the Customer.
- It is the responsibility of the Customer to inform RBL Bank of any change in the Customer’s mobile number or loss/ theft of the Device in accordance with the procedure laid down by RBL Bank.
- The telecom service provider of the Customer may levy charges for each SMS/ dial/GPRS and RBL Bank is not liable for any dispute that may arise between such telecom service provider and the Customer.
- In an event the Customer updates their email ID via MyBank, the revised email ID shall get updated across all accounts of the Customer under the CIF as the preferred email ID of the Customer for all future communications from RBL Bank. NRIs will not be able to update the email IDs via MyBank.
11. Fee structure for the Facility:
RBL Bank reserves the right to charge the Customer a fee for the use of the services provided under the Facility and change the fee structure at its discretion. Display of such charges on Bank’s websites would serve as sufficient notice and the same is binding on the customer.
12. Accuracy of Information:
- The Customer agrees to provide accurate and up-to-date identification details as registered with RBL Bank. In the event of any discrepancy or inaccuracy in the information provided, the Customer shall indemnify RBL Bank against any liability, loss, or damages arising therefrom. Additionally, the Customer undertakes to promptly notify RBL Bank of any changes to their KYC details within the timeframe as stipulated by RBL Bank.
- The Customer acknowledges that they shall not hold RBL Bank responsible for any loss, damage, or inconvenience resulting from incorrect or inaccurate information provided to RBL Bank.
- The Customer understands, agrees and confirms that RBL Bank may, at its sole discretion, record in such mode and manner and retain and use in any manner for such period of time as deemed fit by RBL Bank, any and all information received from the Customer. The Customer further agrees and confirms that information as well as the data so stored may be used and relied upon by RBL Bank as conclusive proof and binding for all purposes, may be given as evidence to any Authority.
- The Customer accepts that RBL Bank shall not be responsible for any errors which may occur despite the steps taken by RBL Bank to ensure the accuracy of the information and shall not have any claim against RBL Bank in an event of any loss/ damage suffered as a consequence of an information provided by RBL Bank found to be not correct.
13. Sharing of Information:
To the extent not prohibited by Applicable Law, RBL Bank shall be entitled to transfer any information relating to the Customer and/or any other information given by the Customer for utilization of the Facilities including any information and/ or instructions, to and between its branches, subsidiaries, representative offices, affiliates, representatives, Authority, auditors and agents of RBL Bank, Service Providers and other third parties selected by RBL Bank, wherever situated, for confidential use in and in connection with the Facilities.
14. Disclaimer of Liabilities:
- The Customer acknowledges and agrees that RBL Bank shall not be liable for any direct, indirect, or consequential damage or losses arising from the disruption, unavailability, or failure of Facility(ies) due to technical errors, telecommunication network failures, or system malfunctions beyond RBL Bank's control.
- The Customer also understands that RBL Bank is not liable for any transaction failures resulting from technical issues.
- RBL Bank shall not be held liable or responsible for any failure or delay, whether directly or indirectly caused by any circumstances beyond the control of RBL Bank, including but not limited to acts of God, systems and communications breakdowns, failures or disruptions, orders or restrictions, war or warlike conditions, hostilities, sanctions, mobilisations, blockades, embargoes, detentions, revolutions, riots, looting, strikes, stoppages of labour, lockouts or other labour troubles, earthquakes, fires or accidents. RBL Bank shall not be held liable to the Customer for any loss, damage, whether direct or indirect, costs, charges or expenses, due to or occasioned by delay/ inability, under any such circumstances.
15. Responsibilities and obligations of the Customer:
- The Customer will be responsible for all transactions, including unauthorised /erroneous/ wrong/ incorrect/mistaken/false transactions made using the Customer(s) Device, SIM card and MPIN, regardless of whether such transactions are in fact entered into or authorized by the Customer(s). The Customer will be responsible for the loss/damage, if any suffered in respect of all such transactions.
- The Customer shall take all possible steps to ensure that the Application and his/her mobile phone are not shared with anyone and shall take immediate action to de-register from mobile banking service as per procedure laid down in case of misuse/ theft/loss of the mobile phone or SIM card.
- The Customer will use the services offered under the Facility using the MPIN in accordance with the procedure as laid down by RBL Bank from time to time, including the terms and conditions contained herein.
- The Customer shall keep the Customer ID and MPIN confidential and will not disclose these to any other person or will not record them in a way that would compromise the confidentiality of the same or the security of the service.
- It will be the responsibility of the Customer to notify RBL Bank immediately if he/ she suspects the misuse of the MPIN. The Customer will also immediately initiate the necessary steps to change his/her MPIN.
- If the Device or SIM is lost, the Customer(s) must immediately act to de-register from mobile banking service at home branch of the primary account enabled for mobile banking service.
- The Customer accepts that any valid transaction originating from the Customer(s) ID and / or Registered Customer Number shall be assumed to have been initiated by the Customer and any transaction authorized by the MPIN is duly and legally authorized by the Customer.
- The Customer shall keep RBL Bank updated regarding any information/ modification relating to the services offered under the Facility which would be publicized on RBL Bank’s Website and at the branches and would be responsible for taking note of / compliance of such information/ modifications in making use of the Facility.
- The Customer shall be liable for all loss or breach of the T&Cs contained herein or contributed or caused the loss by negligent actions or a failure to advise RBL Bank within a reasonable time about any unauthorised access in the account.
- The Customer shall be liable and responsible for all legal compliance and adherence of all commercial terms and conditions in respect of the mobile connection/SIM card/Device through which the Facility is availed and RBL Bank does not accept/ acknowledge any responsibility in this regard.
- It is the responsibility of the Customer to notify RBL Bank, about any change in mode of operation, through a separate communication, making a specific reference to the mobile banking service availed. It is also the responsibility of the Customer to notify RBL Bank, any other change in the operation of the Account which will otherwise make the account ineligible for the mobile banking service. Any failure on the part of the Customer to advise RBL Bank separately shall continue to bind all the account holders, jointly and severally for the transactions through this Facility.
- The Customer(s) shall upgrade their Mybank apps, software, hardware and the operating system at their own cost from time to time and the bank shall be under no obligation to support the software, hardware and operating systems of the user and that the same shall be the sole responsibility of the user.
- The Customer(s) shall take additional measure by ensuring periodic scanning of the Devices with authorized antivirus to safeguard from malware / virus.
- All correspondence / delivery of any instructions or their communication by RBL Bank shall only be made at the registered address and / or email address registered with RBL Bank. RBL Bank shall in no way be held responsible for any non-receipt of the same.
16. Disclaimer:
- RBL Bank, when acting in good faith, shall be absolved of any liability in case: RBL Bank is unable to receive or execute any of the requests from the Customer or there is loss of information during processing or transmission or any unauthorized access by any other person or breach of confidentiality or due to reasons beyond the control of RBL Bank. There is any kind of loss, direct or indirect, incurred by the Customer or any other person due to any failure or lapse in the Facility which are beyond the control of RBL Bank. There is any failure or delay in transmitting of information or there is any error or inaccuracy of information or any other consequence arising from any cause beyond the control of RBL Bank which may include technology failure, mechanical breakdown, power disruption, etc. There is any lapse or failure on the part of the service providers or any third party affecting the said Facility and that RBL Bank makes no warranty as to the quality of the service provided by any such provider.
- RBL Bank, its employees, agent or contractors, officers, shall not be liable for and in respect of any loss or damage whether direct, indirect or consequential, including but not limited to loss of revenue, profit, business, contracts, anticipated savings or goodwill, loss of use or value of any equipment including software, whether foreseeable or not, suffered by the Customer or any person howsoever arising from or relating to any delay, interruption, suspension, resolution or error of RBL Bank in receiving and processing the request and in formulating and returning responses or any failure, delay, interruption, suspension, restriction, or error in transmission of any information or message to and from the telecommunication equipment of the Customer and the network of any service provider and RBL Bank's system or any breakdown, interruption, suspension or failure of the telecommunication equipment of the Customer, RBL Bank's system or the network of any service provider and/or any third party who provides such services as is necessary to provide the Facility.
- RBL Bank will not be responsible if the Application is not compatible with/ does not work on the Device of the Customer.
- RBL Bank shall not be responsible for any failure on the part of the Customer to utilise the Facility due to the Customer not being within the geographical range within which the Facility is offered and which forms part of the roaming network of such cellular service provider, providing services to the Customer availing such roaming facility from the respective cellular service provider. If the Customer has reason to believe that the Registered Customer Number is / has been allotted to another person and / or there has been an unauthorised transaction in the Account and / or the Device is lost, he shall immediately inform RBL Bank of the same.
- The Customer agrees that RBL Bank shall not be liable if:
- the Customer has breached any of the T&Cs, contained herein or
- the Customer has contributed to, or the loss is a result of failure on part of the Customer to advise RBL Bank within a reasonable time about unauthorised access of or erroneous transactions in the Account by use of the Facility; or
- as a result of failure on part of the Customer to advise RBL Bank of a change in or termination of the Customer's Device/SIM cards.
- there has been an unauthorized transaction in the Account as a result of any person having control or custody of telecommunications instrument (such as the Device) so that such instrument may be used to give telecommunications instruction without authorization or any other issue/default/error/technological problem in the telecommunication instrument or duplication of mobile number / SIM of the Customer such as but not limited to SIM card cloning, virus in handset etc.
- RBL Bank shall endeavor to provide the Facility on a best effort basis and the Customer shall not hold RBL Bank liable for nonavailability of the Facility or nonperformance by service providers, if any, engaged by RBL Bank or any loss or damage caused to the Customer as a result of use of the Facility for causes which are not attributable to RBL Bank. RBL Bank shall not be liable in any manner to the Customer in connection with the use of the Facility.
- The Customer accepts that each alert may contain certain Account information relating to the Customer. The Customer authorises RBL Bank to send Account related information, though not specifically requested, if RBL Bank deems that the same is relevant.
- RBL Bank shall not be held responsible for the confidentiality, secrecy and security of the personal or Account information being sent through the Facility. The Customer agrees that the access to the Facility shall be only through the Registered Customer Number and any transaction which originates from the same, whether initiated by the Customer or not, shall be deemed to have originated from the Customer.
- In an event the Customer(s) revokes their consent to share Personal Information necessary for the purposes of these T&Cs, the Customer acknowledges and agrees that the Customer(s) will no longer be able to access or use the Application and RBL Bank reserves the right to terminate the Customer's access to the Application immediately upon receipt of such revocation. The Customer shall not hold RBL Bank liable for the same.
- Under no circumstance, shall RBL Bank be held liable if the Facility is not available for reasons including but not limited to natural calamities, legal restraints, faults in the telecommunication network or network failure, or any other reason beyond the control of RBL Bank. RBL Bank shall not be liable under any circumstances for any damages whatsoever whether such damages are direct, indirect, incidental consequential and irrespective of whether any claim is based on loss of revenue, interruption of business or any loss of any character or nature whatsoever and whether sustained by the Customer or by any other person. Illegal or improper use of the Facility shall render the Customer liable for payment of financial charges as decided by RBL Bank or will result in suspension of the Facility for the Customer.
- RBL Bank is in no way liable for any error or omission in the services provided by any cellular or any third-party service provider (whether appointed by RBL Bank in that behalf or otherwise) to the Customer, which may affect the Facility.
- RBL Bank does not warrant the confidentiality or security of the messages whether personal or otherwise transmitted through the Facility. RBL Bank makes no warranty or representation of any kind in relation to the system and the network or their function or performance or for any loss or damage whenever and howsoever suffered or incurred by the Customer or by any person resulting from or in connection with the Facility.
- Without limitation to the other provisions of these T&Cs, RBL Bank, its employees, agent or contractors, shall not be liable for and in respect of any loss or damage whether direct, indirect or consequential, including but not limited to loss of revenue, profit, business, contracts, anticipated savings or goodwill, loss of use or value of any equipment including software, whether foreseeable or not, suffered by the Customer or any person howsoever arising from or relating to any delay, interruption, suspension, resolution or error of RBL Bank in receiving and processing the request and in formulating and returning responses or any failure, delay, interruption, suspension, restriction, or error in transmission of any information or message to and from the telecommunication equipment of the Customer and the network of any cellular service provider and RBL Bank's system or any breakdown, interruption, suspension or failure of the telecommunication equipment of the Customer, RBL Bank's system or the network of any cellular service provider and/or any third party who provides such services as is necessary to provide the Facility.
- The Customer shall not interfere with or misuse in any manner whatsoever the Facility and in the event of any damage due to improper or fraudulent use by the Customer, the Customer shall be liable for damages to RBL Bank.
- The Customer is solely responsible for protecting their own debit card PIN or Registered Customer Number and any other password that may be issued by RBL Bank for the use of the Facility.
- RBL Bank will not be liable for:
- any unauthorised use of the Customer's debit card PIN, or Registered Customer Number or for any fraudulent, duplicate or erroneous instructions given by use of the Customer's debit card PIN, or Registered Customer Number;
- acting in good faith on any instructions received by RBL Bank from or on behalf of the Customer in relation to the Facility;
- error, default, delay or inability of RBL Bank to act on all or any of the instructions given by the Customer;
- loss of any information/instructions in transmission;
- unauthorized access by any other person to any information /instructions given by the Customer or breach of confidentiality;
- RBL Bank will not be concerned with any dispute between the Customer and any cellular service provider and/ or any third party providing such services, through which the Facility is being availed by the Customer. RBL Bank makes no representation or gives no warranty with respect to the quality of the service provided by any cellular service provider.
17. Indemnity:
- In consideration of RBL Bank providing the Facility, the Customer, at his/her own expense, agrees to indemnify, defend and hold harmless, RBL Bank, its directors and employees, representatives, agents, customers and/or the Affiliates, as the case may be, against all losses, damages, expenses, actions, claims, demands and proceedings whatsoever, that RBL Bank may incur, sustain, suffer or be put to at any time as a consequence of:
- any instructions issued by the Customer in relation to the Facility, whether or not such instructions are acted upon by RBL Bank;
- any failure, delay, omission, or refusal by RBL Bank to act upon such instructions; or
- any use or misuse of the Facility by the Customer or any third party acting on the Customer’s behalf.
- The Customer further agrees to indemnify, defend and hold harmless RBL Bank and/or its Affiliates, against any loss incurred by the Customer due to the Customer’s inability to access or use the Facility, or any delay, interruption, or failure in the provision of services under the Facility, due to any malfunction, disruption, or deficiency in the telecommunications network, internet connectivity, or services provided by the Customer’s cellular or internet service provider.
- The Customer agrees to indemnify, defend and hold harmless, RBL Bank and/or its affiliates from any losses occurring as a result of the:
- the Customer permitting any third party to access or use the Facility, whether with or without the Customer’s knowledge or consent;
- any unauthorized access to the Facility resulting from the Customer’s negligence, including but not limited to, sharing or disclosing access credentials, leaving the mobile device unattended, or failing to secure the mobile device;
- the loss, theft, or misplacement of the Customer’s mobile device or SIM card, or any other circumstance that compromises the security of the Facility.
18. Consents:
- RBL Bank reserves the right through automated means, to collect, store, use, access any Customer(s) communications undertaken via the Application for the purposes of monitoring the Customer(s) high risk or fraudulent transactions and RBL Bank may engage third party service providers or other service providers to assist in these efforts.
- The Customer(s) agree and specifically consent that RBL Bank may collect, store, and use the Customer(s) Personal Information and any communications made through the Application, in accordance with Applicable Laws, and RBL Bank’s Privacy Policy. RBL Bank may collect the following Personal Information including but not limited to personal details such as full name, date of birth, gender, email, mobile, PAN, marital status, father's & mother's name, current and permanent address, bank account number, bank IFSC number; employment & income details such as employment/ profession type, employer/ company name, industry, registration type, individual & household income, office address.
- The Customer(s) agree and specifically consent that the Application may, through automated means, access the Customer(s) navigational, log, and correspondence information/data which will help RBL Bank analyze the merchants, markets, technology, operating systems, browsers, devices, locations from/for which RBL Bank’s are used so as to help RBL Bank to better understand the Customer(s) needs and provide the Customer(s) with Facility(ies) based on the suitability of Customer(s) financial profile.
- The Customer(s) agree and specifically consent that the Application may, through automated means, access the Customer(s) messages (SMS) on the Customer(s) Device/Registered Customer Number and read/use number which is OTP contained in that message (SMS) for auto populating that OTP into the Application for the convenience of the Customers as if the Customers had inputted the OTP. For instance: OTP is a one-time password which is sent to the Customer(s) by the telecom company used by the Customers having a tie up with RBL Bank in order to carry out the second factor authentication with the use of OTP.
- The Customer(s) represents that the Customer(s) have obtained all requisite prior consents and waivers necessary from any third party or recipients and have provided such third party or recipient with notice to permit RBL Bank and its affiliates, to carry out actions described in this paragraph. The Customer(s) further warrants that the Customer(s) will provide such notices and secure such necessary consents and waivers in advance of providing similar information to RBL Bank in the future.
- In an event the Customer(s) chooses to delete or wipe-out any information or data from the MyBank Application or the Account(s) or if the Customer(s) or RBL Bank choose to terminate the use of the Customer(s) Account or the Facility(ies), the Customer(s) understands that the Customer(s) may still retain, use and/or disclose such information/data for legal reasons detailed in the Privacy Policy.
- The Customer(s) agree and specifically consent to the collection, storage and use of the information by RBL Bank through third parties of RBL Bank, send the Customer(s) emails, SMS, or communicate with the Customer(s) through other means, for:
- providing the Customer(s) with Facility(ies) and transactional or account related information;
- sending the Customer(s) payment related reminders/updates;
- promoting Facility(ies) or other services of RBL Bank;
- promoting new products and activities;
- investigating or resolving any product or Facility(ies) related concerns including complaints; or
- RBL Bank may also take one-time access to certain features of the Customer(s) Device like camera, microphone, location or any other facility, necessary for the purposes of on-boarding/ KYC performed by third parties.
- The Customer can delete their Personal Information, in effect revoking their consent for the use of such data any time. However, RBL Bank does not take any responsibility for deletion of such data by its partners, service providers etc.
19. Modification:
RBL Bank shall have the absolute discretion to amend or supplement any of the T&Cs, features and benefits in relation to the Facility. RBL Bank may communicate the amended T&Cs by hosting the same on the Website or in any other manner as decided by RBL Bank. The Customer shall be responsible for regularly reviewing these T&Cs, including amendments thereto as may be posted on the Website and shall be deemed to have accepted the amended T&Cs by continuing to use the Facility.
20. Termination:
- The Customer may request for termination of the Facility at any time by giving a written notice of at least fifteen (15) days to RBL Bank. The Customer will continue to be responsible for any transactions that may have been effected through the Registered Customer Number in relation to the Facility prior to such cancellation of the Facility.
- RBL Bank may, at its discretion, withdraw temporarily or terminate the Facility, either wholly or in part, at any time without giving prior notice to the Customer. RBL Bank may, without prior notice, suspend the Facility at any time during which any maintenance work or repair is required to be carried out or in case of any emergency or for security reasons, which require the suspension of the Facility.
- The closure of all Account(s) of the Customer will automatically terminate the Facility. RBL Bank may suspend or terminate Facility without prior notice if the Customer has breached these T&Cs or RBL Bank learns of the death, bankruptcy or lack of legal capacity of the Customer.
21. Notices:
RBL Bank and the Customer may give notice under these T&Cs electronically to the mailbox of the Customer (which will be regarded as being in writing) or in writing by delivering them by hand or by sending them by post to the registered address of the Customer, last recorded with RBL Bank and in case to RBL Bank at its office at Registered Office - Shahupuri, Kolhapur – 416 001, India and Administrative Office at Mahavir 179/ E, Shri Shahu Market Yard, Kolhapur- 416 005 and Corporate Office at One World Center, Tower 2, 6th Floor, 841, Senapati Bapat Marg, Lower Parel, Mumbai- 400 013. In addition, RBL Bank shall also provide notice of a general nature regarding the Facility and the Terms and Conditions, which are applicable to all Customers using the Facility, on its Website and/ or also by means the customised messages sent to the Customer over his mobile phone as SMS or other mode as may be deemed fit by RBL Bank. Such notice will be deemed to have been served individually to each Customer.
22. Disclosure of Information:
The Customer hereby irrevocably agrees to and consents that in addition to the above mentioned right or any other right which RBL Bank and its affiliates may at any time be entitled whether by operation of law, contract or otherwise, RBL Bank is authorized / will be entitled: (i) to combine or consolidate at any time all or any of the Accounts and liabilities of the Customer with or to any branch of RBL Bank and/or its affiliates; (ii) to sell or otherwise dispose off any of the Customers’ securities or properties held by RBL Bank by way of public or private sale or otherwise without having to institute any judicial proceeding whatsoever and retain/appropriate from the proceeds derived there from the total amounts outstanding to RBL Bank and/or to the affiliates from the Customer, including costs and expenses in connection with such sale or disposal; and (iii) in case of cross currency set-off, to convert an obligation in one currency to another currency at a rate determined at the sole discretion of RBL Bank and/or its affiliates.
23. Setting Triggers and Receiving Alerts:
RBL Bank may, in its discretion, not give effect to any Triggers if RBL Bank reasonably believes (which decision of RBL Bank shall be binding on the Customer) that the Triggers are not genuine or otherwise improper or unclear or raise a doubt or in case any Triggers cannot be put into effect for any reasons whatsoever.
The Customer is responsible for intimating to RBL Bank any change in the Customer(s) Registered Customer Number or email address or Account details and RBL Bank will not be liable for sending Alerts or other information over the Registered Customer Number /email address recorded with RBL Bank.
The Customer acknowledges that to receive Alerts, the Customer(s) Registered Customer Number must be active and accessible. The Customer acknowledges that if the Customer's Registered Customer Number remains inaccessible for a continuous period (such period dependent upon service providers) from the time an Alert is sent by RBL Bank, that particular Alert may not be received by the Customer.
Triggers will be processed by RBL Bank after receipt and RBL Bank shall have the discretion to determine the time taken to process such request. The Customer acknowledges that there shall be an intervening period between receipt of Triggers by RBL Bank, process of the Triggers and the time that the Alerts are sent.
The Customer acknowledges that the provision of the Facility is dependent on the infrastructure, connectivity and services to be provided by service providers engaged by RBL Bank or otherwise. The Customer accepts that timelines, accuracy and readability of Alerts sent by RBL Bank will depend on factors affecting other service providers engaged by RBL Bank or otherwise. RBL Bank shall not be liable for non-delivery or delayed delivery of Alerts, error, loss or distortion in transmission of Alerts to the Customer.
24. Right to Set-Off:
RBL Bank and its affiliates shall have the paramount right of set-off and lien, irrespective of any other lien or charge, present as well as future on the deposits of any kind and nature (including fixed deposits) held/ balances lying in any other Account(s) of the Customer maintained with RBL Bank and / or affiliates, whether in single name or joint name(s) and on any monies, securities, bonds and all other assets, documents and properties held by/ under the control of RBL Bank and/or affiliates (whether by way of security or otherwise pursuant to any contract entered/ to be entered into by the Customer(s) in any capacity) towards the satisfaction of the Customer’s liability under the Facility. RBL Bank and/ or affiliates are entitled without any notice to the Customer, to settle any indebtedness whatsoever owed by the Customer(s) to RBL Bank and/or affiliates, (whether actual or contingent, or whether primary or collateral, or whether joint and/or several) hereunder or under any other document/ agreement, by adjusting, setting-off any deposit(s) and/or transferring monies lying to the balance of any Account(s) held by the Customer with RBL Bank and/or affiliates notwithstanding that the deposit(s)/ balances lying in such Account(s) may not be expressed in the same currency as such indebtedness. RBL Bank's and its affiliates’ rights hereunder shall not be affected by the Customer’s bankruptcy, death or winding up. It shall be the Customer’s sole responsibility and liability to settle all disputes/ objections with any such joint account holders.
25. Governing Law & Jurisdiction:
The Facility and the T&Cs of the same are governed by the Applicable Laws in India. Any dispute or claim pertain to the Facility and /or the T&Cs herein are subject to the exclusive jurisdictions of competent courts/tribunals/forums in Mumbai and the Customer agrees to such exclusive jurisdictions in Mumbai.
26. Grievance Redressal Mechanism:
The Customer acknowledges that any complaints regarding the Facility can be directed to the grievance redressal cell within RBL Bank via RBL Bank's Website for resolution. If the Customer does not receive a satisfactory response within thirty (30) days of lodging the complaint, the Customer may then escalate the matter to the Ombudsman appointed by the Reserve Bank of India, as per the Banking Ombudsman Scheme, 2021. Details of the Ombudsman for the region where the Customer holds the account are available at www.bankingombudsman.rbi.org.in.
27. Assignment:
RBL Bank shall be entitled to transfer or assign RBL Bank’s rights and obligations under these T&Cs to any person in whole or in part and in such manner as RBL Bank may decide at its sole discretion. Any such transfer or assignment shall conclusively bind the Customer(s). The Customer(s) shall not be entitled to transfer or assign any of its rights and obligations under these T&Cs.
28. Waiver:
No failure or delay by RBL Bank in exercising any right, power or privilege hereunder shall operate as a waiver thereof nor shall any single or partial exercise of any other right, power or privilege. The rights and remedies of RBL Bank hereunder are cumulative and not exclusive of any rights or remedies available in law.
29. Further Assurances:
In connection with these services, the Customer agrees to execute and deliver such additional documents and perform actions as may be necessary or reasonably requested by RBL Bank to carry out or evidence the transactions/services carried out or contemplated under these services.
30. Severability:
Any provision of these T&Cs that is prohibited or unenforceable in any jurisdiction shall, as to such jurisdiction, be ineffective to the extent of prohibition or unenforceability but shall not invalidate the remaining provisions of these T&Cs or affect such provision in any other jurisdiction.
A. Additional Terms and Conditions for the use of the Bharat Bill Pay Service(s) (BBPS):
1. Definitions:
The following words and phrases shall have the meanings as set below unless the context indicated otherwise:
- “Aggregator(s)” shall mean the online payment aggregators who will facilitate online Payments by acting as intermediaries between the Customers and the Billing Company.
- “Auto Pay” shall mean the automatic debit instruction to make Payment for the Utility availed or used by the Customer for the entire amount or the amount specified by the Customer.
- “Bill Payment Services” refers to the bill payment services offered by RBL Bank to Customers through digital channels such as mobile banking, retail internet banking, corporate internet banking and any other modes as may be specified by RBL Bank from time to time to make Payments for utility bills such as electricity, telecom, water, education fees, municipal taxes etc.
- “Bill” shall refer to a structured and predefined request for Payment issued by a Billing Company or Biller to a Customer for Utilities provided to be paid within a stipulated period.
- “Billing Company” or “Biller” shall mean an entity issuing Bills or invoices for the Utilities offered to the Customers and accept Payments through multiple modes from the Customers.
- “Customers” shall mean a resident of India who is the sole or first holder of Account and who has availed the Bill Payment Services.
- “Due Date” means the date on which the payment for the Utilities becomes due as determined the Billing Company(ies).
- “Effective Date” means the date specified by the Customer for effecting AutoPay.
- “NPCI” means the National Payments Corporation of India.
- “Payments” shall mean the amount that the Customer is required to pay for the Utilities availed by the Customer by using the Bill Payment Services through charge/ debit to the Customer’s Account.
- “Service Provider(s)" shall mean any person appointed by RBL Bank under a principal-to principal contract to provide any service related to the Bill Payment Services and who also has a principal-to-principal contract for services with the relevant Billing Company in relation to Utilities.
- “Utilities" shall mean the goods, and services offered by Billing Company under the purview of Bill Payment, from time to time, either directly or through Service Provider(s), which the Customer may avail of and/or make Payment for, as the case may be.
2. Role of RBL Bank in Bill Payment Services:
- The Customer acknowledges that RBL Bank is acting solely in the capacity of a facilitator of Payments and not in the capacity of a beneficiary/ Billing Company.
- The Customer understands that RBL Bank enables the Bill Payment Services through:
- Infrastructure where the Billing Company is registered with NPCI for Bill Payments.
- Aggregators with whom RBL Bank has an agreement.
- The Customer recognises that all Payments are routed through NPCI/Aggregator and the RBL Bank has no direct contact with the Billing Company.
- The Customer is advised to make Payments well in advance and avoid making Payments on the Due Date to ensure timely settlement.
3. Instructions:
- The Customer agrees and accepts that RBL Bank, through the Bill Payment Service, will enable Payments of Bill basis instructions provided by the Customer from time to time.
- The Customer agrees that the record of the instructions given and transactions with RBL Bank shall be conclusive proof and binding for all purposes and can be used as evidence in any proceeding,
- All instructions for availing the Bill Payment Service shall be given by the Customer to RBL Bank in the manner and through a medium prescribed by RBL Bank.
- The Customer shall be responsible for the accuracy and authenticity of the instructions provided to RBL Bank. It is understood and accepted by the Customer that RBL Bank shall have no obligation to verify the authenticity of the instruction received or purported to have been sent from the Customer unless withdrawn by further instructions within a short span of time.
- The processing of all the instructions is subject to the availability of free, clear and available funds in the Account of the Customer. In case of insufficiency of funds, RBL Bank shall not be held liable for not processing the instructions and not making the Payments to the Bill Company.
- It is accepted by the Customer that RBL Bank shall not be held liable for in an event it does not or is unable to prevent the implementation of initial instructions.
- In an event RBL Bank considers the instructions to be inconsistent or contradictory, RBL Bank reserves the right to seek clarity from the Customer or may act upon the instructions as it may think fit.
- Billing Companies from time to time and in particular instances specify the date on which Payment is to be made, and notwithstanding any instructions given by the Customer in this regard, RBL Bank shall have the authority from the Customer to cause Payment only on the date specified by the Billing Company.
- The Customer understands and acknowledges that RBL Bank reserves the right to refuse execution of any instructions without providing a reason and is not obligated to assess their prudence or feasibility.
- RBL Bank may suspend or restrict access to the Bill Payment Services if it believes the instructions could result in direct or indirect loss, are unauthorized, erroneous, fraudulent, or violate Applicable Laws, regulations, or internal policies.
4. Accuracy of Information:
- The Customer agrees to provide accurate and up-to-date identification details as registered with the Billing Company. In the event of any discrepancy or inaccuracy in the information provided, the Customer shall indemnify RBL Bank against any liability, loss, or damages arising therefrom. Additionally, the Customer undertakes to promptly notify RBL Bank of any changes to their KYC details, as registered with the Billing Company, within the timeframe as stipulated by RBL Bank.
- The Customer acknowledges that they shall not hold RBL Bank responsible for any loss, damage, or inconvenience resulting from incorrect or inaccurate information contained in the Bill(s).
- The Customer acknowledges and agrees to furnish the requisite information as specified by the Billing Company and other essential data pertaining to the Bill(s) so as to identify the same and confirm that the information provided in relation to the Bill Payment Services is under the control of the Customer.
- The Customer agrees to make Payments for the Bills raised by the Billing Company and RBL Bank shall not be held responsible in an event the Billing Company rejects the Payment due to incorrect or incomplete information provided by the Customer or in any other circumstances.
- The Customer acknowledged that the information so furnished is subject to the authentication by the Billing Company. The Customer understands that in an event the Billing Company does not confirm if the Customer’s Biller has been registered and if the registration is successful/ failed and the Customer understands and acknowledges that the role of RBL Bank is merely to facilitate the Payment of the Bills of the Customer once the registration is successful.
- The Customer understands, agrees and confirms that RBL Bank may, at its sole discretion, record in such mode and manner and retain and use in any manner for such period of time as deemed fit by RBL Bank, any and all information received from the Customer. The Customer further agrees and confirms that information as well as the data so stored may be used and relied upon by RBL Bank as conclusive proof and binding for all purposes, may be given as evidence to any Authority. In this context, the Customer shall not hold RBL Bank be liable in any way whatsoever in view of the Bill Payment Service being provided/ offered at the request of the Customer.
5. Sharing of Information:
- To the extent not prohibited by Applicable Law, RBL Bank shall be entitled to transfer any information relating to the Customer and/or any other information given by the Customer for utilization of the Bill Payment Services including any information and/ or instructions, to and between its branches, subsidiaries, representative offices, affiliates, representatives, Authority, auditors and agents of RBL Bank, Service Providers and other third parties selected by RBL Bank, wherever situated, for confidential use in and in connection with the Bill Pay Services.
- The Customer fully consent to the Billing Company sharing their billing details with RBL Bank and has no objections to this disclosure in any capacity.
- The Customer authorizes and grants RBL Bank permission to access, store, retrieve, and share the necessary data as required for communication with NPCI and the Billing Company.
6. Disclaimer of Liabilities:
- The Customer acknowledges and agrees that RBL Bank shall not be liable for any direct, indirect, or consequential damage or losses arising from the disruption, unavailability, or failure of Bill Payment Service due to technical errors, telecommunication network failures, or system malfunctions beyond RBL Bank's control.
- Furthermore, the Customer agrees and understands that RBL Bank shall not be responsible for any technical issues affecting the periodic retrieval of Bills from Billing Companies, NPCI, or Aggregators, nor for any errors, discrepancies, or inaccuracies in the Bills provided by these entities.
- The Customer also understands that RBL Bank is not liable for any transaction failures resulting from technical or operational issues occurring at the NPCI, Billing Company, or Aggregator’s end.
- In the event that a Billing Company initiates a refund after a transaction has been marked successful, RBL Bank shall not be responsible for any delays or failures in the refund process.
- The Customer understands and acknowledges that RBL Bank shall not be held liable for any losses and/ or damages incurred by the Customer for Autopay transaction failure. RBL Bank disclaims any liability for any direct, indirect, incidental, or consequential damages arising from the failure of an autopay transaction.
- In the event of any dispute related to billing, the Customer shall directly engage with the respective Billing Company. RBL Bank shall not be involved in the resolution of such disputes and shall not be made a party to any such proceedings. The Customer further acknowledges that RBL Bank shall not be liable for any disputes arising due to computational errors, incorrect data, or erroneous billing by the Billing Company.
- RBL Bank neither endorses the Utilities or services offered by the Billing Company or the Service Providers, nor is it in any manner party to any contracts/ agreements that may be executed between the Customers and the Billing Company/ Service Provider.
- The Billing Company/ Service Provider shall be solely responsible to the Customer to render the Utilities for which Payment is to be made and RBL Bank shall not be responsible for any deficiency in the same including but not limited to, deficient quality, delivery, quantity etc. and shall not be made part to any disputes between the Customer and the Billing Company and/or the Service Provider.
- The Customer agrees to not hold RBL Bank responsible for any non-service, delayed service, faulty service or defective or damaged Utilities rendered by the Billing Companies and/or their Service Provider and shall not communicate with RBL Bank in any manner whatsoever, in this regard.
- RBL Bank will endeavour to carry out instructions received by it within the Payment Due Date to each Billing Company However, RBL Bank does not warrant that fulfillment of instructions will not be delayed for reasons beyond its control and shall not be held responsible in such situations as it is dependent on various technology used from time to time, there could be delays and snags in receipt or transmission of any information and/ or instruction to and from RBL Bank, the Customer, Billing Companies and/ or the Service Providers. RBL Bank does not further warrant the receipt of instructions and/ or information.
- RBL Bank shall not be held liable or responsible for any failure or delay, whether directly or indirectly caused by any circumstances beyond the control of RBL Bank, including but not limited to acts of God, systems and communications breakdowns, failures or disruptions, orders or restrictions, war or warlike conditions, hostilities, sanctions, mobilisations, blockades, embargoes, detentions, revolutions, riots, looting, strikes, stoppages of labour, lockouts or other labour troubles, earthquakes, fires or accidents. RBL Bank shall not be held liable to the Customer for any loss, damage, whether direct or indirect, costs, charges or expenses, due to or occasioned by delay/ inability, under any such circumstances.
7. Auto Pay:
- The Customer undertakes to ensure that in case of Auto Pay there would be sufficient clear funds in his accounts on the Effective Date for making payments towards utilities and services. The Customer also understands that RBL Bank shall not be held responsible or liable if it is unable give effect to Auto Pay due to insufficient funds in the account on the Effective Date.
- In an event the Payment is made from a source other than RBL Bank, the Auto Pay feature will still be executed unless the Customer updates the preference of Payment to manual or cancels the registration. In such cases, RBL Bank will not be responsible for any resulting events, consequences, or losses.
- The Customer acknowledges that Auto Pay will only be processed if the Billing Company presents the Bill with valid details.
- The Customer acknowledges and agrees that RBL Bank shall not be held responsible for any delays in settlement with the Biller while using instant payment services or Auto Pay, whether due to technical issues or any other reasons.
- The Customer acknowledges and agrees that RBL Bank reserves the right to suspend or terminate Auto Pay registrations in the event successful Payments are not made for consecutive months, as determined and communicated by RBL Bank from time to time at the sole discretion of RBL Bank.
- The Customer understands that in an event the amount of Bill exceeds the maximum limit set up by the Customer for Auto Pay, RBL Bank shall not make payments of such Bills.
8. Indemnity:

In consideration of RBL Bank agreeing to provide to the Customer the Bill Payment Service, the Customer hereby irrevocably agrees, to indemnify and keep RBL Bank, its officers, directors, employees, and agents, and/or the Affiliates indemnified and harmless, at all times hereafter, from all losses, damages, costs, charges and consequences, legal fees and expenses, whatsoever, suffered or incurred by RBL Bank on account of any claims, actions, suits or otherwise instituted by the Customer, or by any third party whatsoever, arising out of or in connection with:

any and all transactions initiated by the use of Bill Payment Services.

violations of these T&Cs by the Customer.
-
upon any unauthorized use of the Bill Payment Services by the Customer.
-
upon execution of or acting upon any instructions/information, cancellations, messages and communication sent, with or without the knowledge of the Customer, or whether the same has been initiated bona fide or otherwise.

The Customer acknowledges and agrees that this indemnity shall remain valid, binding, and enforceable at all times, including after the suspension, termination, or partial or complete withdrawal by the Customer from the use of the Bill Payment Service, and shall survive the cessation of the Customer’s relationship with RBL Bank in respect of the said service.
9. Termination, Withdrawal or Suspension of the Bill Payment Service:

The Customer acknowledges and agrees that RBL Bank reserves the right to withdraw the Bill Payment Services, in whole or in part, for any or all of the Customer's Account(s) at its sole discretion. RBL Bank may exercise this right at any time, without prior notice and without providing any reason.

The Customer may cancel the registration at any time by deregistering with the Billing Company. However, the Customer shall remain responsible for all transactions made through the Bill Payment Services until the time of such de-registration.

RBL Bank reserves the right, but shall not be obliged, at any time, without any specific or prior notice to the Customer, to suspend for any duration/ terminate to make changes, enhancements, and/ or modifications any or all of the Bill Payment Services offered by RBL Bank.

It is accepted by the Customer that RBL Bank may also suspend provision of Bill Payment Service if the Customer’s account has insufficient funds, is subject to restrictions or legal claims, or if the transaction raises concerns related to anti-money laundering, counter-terrorism financing, or other compliance risks. RBL Bank shall not be liable for any losses, claims, or damages arising from such refusal, suspension, or restriction of the Bill Payment Service.
10. Property Rights:
The Customer acknowledges that all property rights shall at all times belong to RBL Bank or the relevant third-party vendors, advertisers, affiliates, where applicable. The Customer shall not attempt or reproduce, copy, transmit, publish, perform, broadcast, adapt, store, distribute, display, license, alter and/or hyperlink the property rights without RBL Bank’s prior written consent.
B. Additional Terms and Conditions for the use of the Unified Payments Interface (UPI):
1. Definitions:
The following words and phrases shall have the meanings as set below unless the context indicated otherwise:
- “Authorised Transaction” shall mean the Transaction initiated by the Customer(s) using its credentials viz. UPI PIN, passcode etc. through UPI as stipulated in these T&Cs.
- “Customers” shall mean a resident of India who is the sole or first holder of Account and who has downloaded RBL Bank’s Mobile Banking Application and who is eligible for availing fund transfer facility to send or receive money offered thereunder.
- “Merchant(s)” shall mean merchant(s) who provides goods and services to the Customer at its physical stores.
- “NPCI” means the National Payments Corporation of India.
- “Payer” shall mean any Customer who desires to pay money to the Receiver or the Merchant online using the Facility.
- “Payment Service Provider or “PSP” shall mean entities which are allowed to issue VPA to the Customer(s) and provide payment (credit/debit) services to individuals or entities and regulated by RBI, in accordance with the Payments and Settlement Systems Act, 2007.
- “Receiver" shall mean any person or the Merchant holding a banking account, who are desirous to receive payments from the Payer over the internet using the UPI Services. In case the Payer is customer of the Merchant and is paying money to the Merchant for purchase or utilization of goods and services from the Merchant, the Merchant shall be the Receiver.
- “Transaction” shall mean the fund transfer service to send or receive money offered on the Application.
- “UPI Facility” shall mean Unified Payments Interface, a multi-platform operable payment network solution which is being provided by NPCI for the purpose of inter-bank transfer of funds i.e., pay someone (push) or collect from someone (pull) or merchant payments or other eligible services pursuant to the rules, regulations and guidelines issued by NPCI, RBI and RBL Bank, from time to time.
- “UPI PIN” shall mean password, biometrics, PIN etc., as created by the Customer(s) or provided by RBL Bank from time to time, which shall be required by the Customer(s) to debit an account or completion of the transfer of funds through UPI.
- “Virtual Payment Address” or “VPA” shall mean a payment identifier for sending/collecting money enabling the Customer(s) to complete a Transaction without having to enter the account credentials of the beneficiary.
2. Authorisation:
- The Customer irrevocably and unconditionally authorizes RBL Bank to access his Account and the Personal Information registered while authentication of Application for availing the service including effecting banking or other transactions of the Customer through the facility.
- The Customer expressly authorizes RBL Bank to disclose to the service provider or any other third party, all Customer information in its possession, as may be required by them to provide the services offered under the said facility to the Customer.
- The authority to record the Customer’s details and transaction details is hereby expressly granted by the Customer to RBL Bank. All records generated by the transactions arising out of use of the facility, including the time of the transaction, beneficiary details, etc. recorded shall be conclusive proof of the genuineness and accuracy of the Transactions and can be used as evidence in any proceeding.
- The Customer authorizes RBL Bank to send any message or make calls to his/her mobile phone Number or display banners or any other communication on Application to inform him about any promotional offers including information regarding RBL Bank’s new products either now available or which RBL Bank may come up with in the future, greetings, banners or any other promotional messages or any other message that RBL Bank may consider appropriate to the Customer. The Customer irrevocably and unconditionally agrees that such calls or messages made by the RBL Bank and/or its agents shall not be construed as a breach of the privacy of the Customer and shall not be proceeded against accordingly.
- The Customer authorizes RBL Bank to send any rejection message or to reject any Transaction/request, if it finds that the request sent by the Customer is not as per the requirements stipulated by RBL Bank for availing the facility.
- The Customer authorizes RBL Bank to do a bureau scrub or extract his credit report from the bureau for offering various products or services. The Customer expressly authorizes RBL Bank to carry out all request(s) or transaction(s) for and/or at the request of the Customer as are available to the Customer through Application without RBL Bank having to verify the authenticity of any request or Transaction purporting to have been received from the Customer through Application.
- RBL Bank shall have the option to introduce any new services through this facility at any time in future and the Customer shall be deemed to have expressly authorized RBL Bank to register the Customer for such new services.
3. General business rules governing UPI Facility:
- UPI Facility offers an instant, interbank electronic fund transfer or fund collection service to the Customer(s). The Customer(s) can put in request for fund transfer or fund collection for its linked Account.
- The UPI Facility shall follow the process prescribed by NPCI.
- The UPI Facility shall be available to Customer(s) who have registered for the UPI Facility as per the discretion of RBL Bank, NPCI and RBI.
- Customer(s) shall register for using the UPI Facility in such manner and through such modes as may be specified and made available by RBL Bank from time to time for availment and use of UPI Facility.
- RBL Bank reserves the right to charge the Customer(s) for the services offered under the said UPI Facility.
- UPI Facility will be provided by RBL Bank at the request of the Customer(s) to enable them to send or receive the funds through Application to the VPA added in the application based on the instructions received from Customer(s).
- The Customer(s) irrevocably and unconditionally authorizes RBL Bank to debit or credit the account/s with RBL Bank registered for availing UPI Facility.
- The daily upper ceiling per Customer(s) shall be as per the guidelines laid down by NPCI or respective bank, where the Customer(s) maintains his account applicable for funds transfer within India.
- Entering the wrong UPI PIN thrice will block the UPI Facility for the day and three such consecutive blockages will de-activate the Customer(s) from the UPI Facility and the Customer(s) should re-register for the UPI Facility as per the procedure laid down for the same. Any change in the business rules of any of the processes will be notified on RBL Bank's Website which will be construed as sufficient notice to the Customer(s). No separate notice or information shall be sent to the Customer(s) individually or collectively and RBL Bank shall not be liable for any losses incurred by the Customer(s) due to not sending such notice or information.
- RBL Bank shall endeavor to provide to the Customer(s) through Application, such services as it may decide from time to time. RBL Bank reserves the right to decide the type of services, which category of Customer(s) shall be offered on each account type and may differ from category to category.
- RBL Bank may also make additions /deletions to the services offered through Application at its sole discretion.
- Once a Virtual Payment Address is created by the Customer(s), the same Virtual Payment Address will not be allowed to be created by the Customer(s) or other Customer(s)s or any person till the same is active except for the reason of it being inactive for the next two (2) years from the date of such creation of the Virtual Payment Address.
- There will be no obligation on RBL Bank to support all the versions of existing Device operating systems and new versions of mobile phone operating systems as and when those are released. RBL Bank can withdraw support to existing version of operating system without prior notice to the Customer(s).
- The Customer(s) agrees that the Customer(s) shall use only the Device to access the Application offered by RBL Bank. The access is restricted to him/her on the Registered Customer Number for UPI service.
- The Customer(s) is responsible for the correctness of information supplied to RBL Bank through the use of UPI or through any other means such as electronic mail or written communication. RBL Bank does not accept any liability for the consequences arising out of erroneous information supplied by the Customer(s).
- The Customer(s) agrees to use single Device for accessing the services under UPI. Change of Device set shall be properly re-registered according to the UPI Application requirement.
- The Customer(s) agrees that dispute resolution shall be as per the guidelines issued by NPCI from time to time.
4. Responsibilities of the Customer(s):

The Customer(s) shall be responsible for the accuracy of any information provided by the Customer(s) for availing the facility.

The Customer(s) shall be solely responsible for fund transfer through Payment Application to the correct VPA.
-
The Customer(s) shall also be responsible for complying with the applicable Anti-Money Laundering (AML) norms governing such funds transfers as stipulated by RBI, from time to time.
-
The Customer(s) shall be liable and responsible in case of any discrepancy found in the information provided by him for availing of fund transfer service offered through the Application.
-
In an event the Customer(s) suspects that, there is an error in the information supplied by RBL Bank, the Customer(s) shall inform RBL Bank immediately. RBL Bank will endeavor to correct the error promptly wherever possible on a best effort basis.
-
RBL Bank shall not be held liable for any loss suffered by the Customer(s) due to disclosure of the Personal Information to any service provider or third party by RBL Bank, for reasons including but not limited to participation in any telecommunication or electronic clearing network, in compliance with any legal or regulatory directives, for statistical analysis or for credit rating or for any legal or regulatory compliance.

The Customer(s) shall be solely responsible for protecting his Device and UPI PIN for the use of the UPI Facility.

The Customer(s) shall be liable to RBL Bank for any kind of unauthorized or unlawful use of any of the UPI PIN/passwords or of the Application or any fraudulent or erroneous instruction given and any financial charges thus incurred shall be payable by the Customer(s) only.

The Customer(s) accepts that for the purposes of the UPI Facility any transaction emanating from the Registered Customer Number shall be assumed to have initiated by the Customer(s) at his sole discretion.
-
It is the sole responsibility of the Customer(s) to request RBL Bank, to suspend the UPI Facility due to change of the Customer(s) Registered Customer Number or if the Device has been lost or has been allotted to some other person. The Customer(s) shall also be obliged to inform RBL Bank, if any, unauthorized transaction in his Account, of which he has knowledge.

It shall be the responsibility of the Customer(s) to update him with regard to any information relating to the services as RBL Bank may decide to provide certain other additional services under the UPI Facility. RBL Bank shall not be responsible for any disregard on the part of the Customer(s).

RBL Bank disclaims all liability for execution of any Payment instruction in good faith and in compliance with the instructions given by the Customer(s).
-
The Customer(s) authorises RBL Bank to act as a PSP and debit Account(s) as per instructions received by way of Payment instructions. The Customer(s) understands that although multiple bank accounts can be linked with the UPI Facility, debit/credit transactions can be done from the default account. The Customer(s) may change the default account before initiating such debit/credit transactions. Each Account that may be linked with the UPI facility can be opened with a separate Customer(s)name/ VPA.

The Customer(s) will ensure availability of funds in the Customer(s) Account(s) towards the fulfillment of the Payment instruction before/at the time of the execution of the Payment instruction by RBL Bank. The Customer(s) hereby authorises RBL Bank to debit the Account(s) of the Customer(s) for any liability incurred by RBL Bank on behalf of the Customer(s) for execution of the instruction issued by the Customer(s). The Customer(s) understands and agrees that once a fund collection request is accepted, the default account will automatically be credited with such amounts as may be mentioned in the fund collection request. The Customer(s) understands and agrees that such amounts once credited to the default account cannot be reversed by the Customer(s).

The Customer(s) agrees that the Payment instruction will become binding when it is executed by RBL Bank.
-
The Customer(s) agrees that the Customer(s) will not be entitled to make any claim against RBI, NPCI and/or RBL Bank with respect to the UPI Facility.
-
The Customer(s) agrees that in the event of any delay in the completion of the fund transfer or any loss on account of error in the execution of the fund transfer pursuant to a Payment instruction or on account of error, negligence or fraud on the part of the Customer(s), RBL Bank will have no liability whatsoever with respect to the same.
-
The Customer(s) will provide the correct beneficiary details to RBL Bank at the time of availing the UPI Facility. The Customer(s) will be solely responsible for entering wrong beneficiary details such as incorrect Virtual Payment Address, incorrect Aadhaar number or an incorrect mobile number, due to which the funds get transferred to an incorrect beneficiary.

The Customer(s) will not hold RBL Bank responsible for any damage, claim and/or issues arising out of or in connection with any purchase of goods/services from Merchants through Payment instructions issued by UPI Facility. The Customer(s) understands and agrees that all such losses, damages and issues will constitute a claim against such Merchants.

The Customer(s) agrees that the UPI Facility is offered in line with RBI’s guidelines on mobile banking and all other relevant guidelines/circulars issued by RBI/ NPCI which are subject to change from time to time.
-
The Customer(s) will inform RBL Bank immediately regarding any inquiry, question or issue raised by any Authority including but not limited to any statutory or official authority regarding and relating to RBL Bank, as well as expeditiously notify RBL Bank of any show causes, seizure or similar action and provide copies of any notices, memos or correspondences received from such Authority. The Customer(s) will not unilaterally file any response/reply to such an Authority without prior approval and vetting by RBL Bank.

The Customer(s) will be solely liable for ensuring availability of sufficient funds in the Account(s) at all times for the purpose of availing the UPI Facility. The Customer(s) agrees that in the event there are insufficient funds in the Account, RBL Bank will decline the Transaction instruction.

The Customer(s) shall be liable for all loss if the Customer(s) has breached the T&Cs contained herein and other applicable terms & conditions or contributed or caused the loss by negligent actions or a failure on his part to advise RBL Bank within a reasonable time about any unauthorized access made on his behalf in the Application.

The Customer(s) shall agree that by use of UPI Facility, the Customer(s) shall be deemed to have agreed to all the T&Cs and such T&Cs shall be binding on the Customer(s) in the same manner as if the Customer(s) has agreed to the same in writing.
5. Responsibilities of RBL Bank:
- RBL Bank will execute a Payment instruction issued and duly authorised by the Customer(s) unless:
- the funds available in the Account(s) of the Customer(s) are not adequate or the funds are not properly applicable/available to comply with the Payment instruction; or
- the Payment instruction is incomplete or it is not issued in the agreed form; or
- RBL Bank has reason to believe that the Payment instruction is issued to carry out an unlawful transaction; or
- the Payment instruction cannot be executed under the NPCI UPI system.
- No Payment instruction issued by the Customer(s) will be binding on RBL Bank until RBL Bank has accepted it.
- For execution of every Payment instruction, RBL Bank will be entitled to debit the designated Account(s) of the Customer(s), with the amount of the funds to be transferred together with charges payable thereon.
- A duly authenticated record of the Transaction after completion of the fund transfer or fund collection or response to a fund collect request will be recorded in the statement of account in the Application of RBL Bank. The transaction will also be recorded in the statement of Account issued by the Customer(s)’s bank to the Customer(s). The Customer(s) will, within a period of ten (10) days from the date of receipt of the monthly statement, report to RBL Bank any discrepancy in the execution of the Payment instruction. The Customer(s) agrees that the Customer(s) will not be entitled to dispute the correctness of the execution of the Payment instruction or the amount debited to the Customer(s) Account(s) if the Customer(s) fails to report the discrepancy within the said period.
- RBL Bank will follow the process prescribed by NPCI for providing the UPI Facility to the Customer(s) in this regard, including but not limited to process for settling of timed out transactions within the time limit prescribed by NPCI.
- RBL Bank may review Customer(s) transactions for identifying high risk transactions and reserves the right to not process the transaction if it believes it to be suspicious, fraudulent or unusual and report the transaction and Customer(s) account details to legal enforcement agencies or other regulatory authorities, as applicable or notified by law.
- RBL Bank will be entitled to recover the applicable charges (including Merchant discount rate) levied by the any regulatory authority including NPCI, by either sending the Customer(s) an invoice on the Customer(s)’s registered e-mail ID which the Customer(s) will process and make payments within a period of seven (7) working days from the date of the receipt of the invoice, failing which, RBL Bank will be entitled to debit the Customer(s) account held with RBL Bank for the pending invoice amount with no further notice. RBL Bank will be entitled to debit the Customer(s)’ Account with such applicable charges associated with the usage of the services selected by the Customer(s) on a daily basis. The Customer(s) agrees to sufficiently fund their account so that the payment of applicable charges can be carried out unimpeded, failure towards which will be considered a material breach of contract, leading to the suspension of services till such time that the payment is received by RBL Bank. RBL Bank will in no way be liable or responsible for any direct, indirect, special or exemplary losses that may occur to the Customer(s) as a result of debits made from the Customer(s) account in accordance with this clause.
6. Instructions:
- The Customer(s) is responsible for the accuracy and authenticity of the instructions provided to RBL Bank and the same, if it is in the form and manner prescribed by RBL Bank, will be considered to be sufficient to operate the UPI Facility. RBL Bank will not be required to independently verify the instructions. RBL Bank has no liability if it does not or is unable to stop or prevent the implementation of any Payment instruction issued by the Customer(s). Once a Payment instruction is issued by the Customer(s) the same cannot be subsequently revoked by the Customer(s).
- RBL Bank will refuse to comply with the instructions without assigning any reason and will not be under any duty to assess the prudence or otherwise of any instruction. RBL Bank has the right to suspend the transactions with respect to the UPI Facility if it has reason to believe that the Customer(s)’s instructions will lead to direct or indirect loss to RBL Bank or may require an indemnity from the Customer(s) before continuing to operate the UPI Facility.
- All instructions, requests, directives, orders and directions entered by the Customer(s) are based upon the Customer(s)’s decisions and considered to be the sole responsibility of the Customer(s).
7. Sharing of Information:
The Customer(s) irrevocably and unconditionally authorises RBL Bank to access and use all information in the Customer(s)’s Account(s) and records received while facilitating the UPI Facility. The Customer(s) agrees that RBL Bank and its affiliates (or their contractors/service providers) may hold and process its Personal Information, any information made available pursuant to processing of the Authorised Transaction and all other information concerning its Account(s) on computer or otherwise in connection with the UPI Facility as well as for analysis, credit scoring and marketing or making offers of various financial or other products and/or services that provide an opportunity to the Customer(s) to acquire, insure, invest, save or otherwise undertake a financial or other transactions.
8. Accuracy of Information:
The Customer(s) takes the responsibility for the correctness of the information supplied by the Customer(s) to RBL Bank through the use of the UPI Facility or through use of the Application or by any other means. The Customer(s) herein accepts that in case of any discrepancy in the information provided by the Customer(s) with regard to UPI Facility the onus shall lie upon the Customer(s) only and thus agrees to furnish accurate information at all times to RBL Bank. RBL Bank shall also not be responsible for any incidental error which occurs in spite of necessary steps being taken by RBL Bank to ensure the accuracy of the information provided to the Customer(s) and the Customer(s) shall not have any claim against RBL Bank in an event of any loss/damage suffered by the Customer(s) as a consequence of the inaccurate information provided by RBL Bank.
9. Disclaimer of Liability:
- RBL Bank does not hold out any warranty and makes no representation about the quality of the UPI Facility. The Customer(s) agrees and acknowledges that RBL Bank will not be liable and in no way be held responsible for any damages whatsoever, whether such damages are direct, indirect, incidental or consequential and irrespective of whether any claim is based on loss of revenue, interruption of business, transaction carried out by the Customer(s) and processed by RBL Bank, information provided or disclosed by RBL Bank regarding the Customer(s)’s Account(s) or any loss of any character or nature whatsoever and whether sustained by the Customer(s) or by any other person.
- While RBL Bank will endeavour to promptly execute and process the Transactions as proposed to be made by the Customer(s), RBL Bank will not be responsible for any non-response or delay in responding due to any reason whatsoever, including failure of operational systems or any requirement of law. RBL Bank will not be liable for any loss, claim or damage suffered by the Customer(s) and/or any other third party arising out of or resulting from failure of a UPI transaction on account of time out transaction i.e. where no response is received from NPCI or the beneficiary bank to the transaction request and/or where the mobile number or account number of the beneficiary does not exist. Further, RBL Bank will also not be liable for any loss, damage and/or claim arising out of or resulting from wrong beneficiary details, mobile number and/or account details being provided by the Customer(s).
- Neither RBL Bank nor its affiliates, directors, officers and/or agents will be liable for any unauthorised persons accessing the records or Account(s) or information through the use of UPI Facility and the Customer(s) hereby fully indemnifies and holds RBL Bank, its affiliates, directors and officers harmless against any action, suit, proceeding initiated against it or any loss, cost or damage incurred by it as a result thereof. RBL Bank will under no circumstance, be held liable to the Customer(s) if UPI Facility is not available in the desired manner for reasons including but not limited to natural calamities, legal restraints, faults in the telecommunication network or network failure, or any other reason beyond the control of RBL Bank.
- Illegal or improper use of the UPI Facility will render the Customer(s) liable for payment of financial charges (to be decided by RBL Bank) or may result in suspension of the UPI Facility to the Customer(s). RBL Bank states that it will have no liability or obligation towards any erroneous transactions getting triggered due to a system bug on the app or system breakdown or for any other reasons solely attributable to the Customer(s) or third-party application.
- All the records of RBL Bank generated by the transactions arising out of the use of the UPI Facility, including the time the transaction is recorded will be conclusive proof of the genuineness and accuracy of the Transaction. For the protection of both the parties and as a tool to correct misunderstandings, the Customer(s) understands, agrees and authorises RBL Bank, at its discretion and without further prior notice to the Customer(s), to monitor and record any or all telephone conversations between the Customer(s) and RBL Bank and any of its employees or agents.
- Notwithstanding anything in contrast provided in these T&Cs, RBL Bank shall not be involved in or in any way liable to the Customer(s) for any dispute between the Customer(s) and a cellular services provider or any third-party service provider (whether appointed by RBL Bank in that behalf or otherwise).
- Any loss incurred by the Customer(s) due to use of the facility by any other person with an express or implied permission of the Customer(s). RBL Bank shall not be held responsible for the confidentiality, secrecy and security of the personal or account information being sent through the facility for affecting the Customer(s)'s instructions.
- RBL Bank shall not be held liable for any loss suffered by the Customer(s) due to disclosure of Personal Information to a third party by RBL Bank, for reasons inclusive but not limited to participation in any telecommunication or electronic clearing network, in compliance with a legal directive, for statistical analysis or for credit rating.
- RBL Bank will not be held liable for any loss of any information during processing or transmission or any unauthorized access by any other person or breach of confidentiality.
- RBL Bank expressly disclaims all warranties of any kind, whether express or implied or statutory, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, data accuracy and completeness and any warranties relating to non-infringement in the UPI Facility.
- There is any lapse or failure on part of the service provider(s) or any third party affecting the UPI Facility and RBL Bank makes no warranty as to the quality of the service provided by any such service provider or any third party.
10. Indemnity:
- The Customer(s) hereby agree, at the Customer(s) own expense to indemnify, defend and hold harmless RBL Bank, its directors and employees, representatives, agents and its affiliates against any claim, suit, action or other proceeding brought against RBL Bank, its affiliates, directors and employees, representatives or agents by a third party, to the extent that such claim, suit, action of other proceeding brought against RBL Bank, its affiliates, directors and employees, representatives or agents is based on or arises in connection with the use of the UPI Facility with reference to:
- Any breach or violation of the T&Cs by the Customer(s);
- any deletions, modification, additions, insertions or alterations to or any unauthorised use of the UPI Facility by the Customer(s);
- any misrepresentation or breach of representation or warranty made by the Customer(s) contained herein;
- any breach of any covenant or obligation to be performed by the Customer(s) hereunder;
- any infringement of intellectual property by the Customer(s);
- fraud, error, inadequate financial capacity to fulfil obligations and/or provide remedies;
- legal risks including but not limited to exposure to fines, penalties or corrective damages resulting from supervisory actions as well as private settlements due to omissions and commissions of the Customer(s);
- against any losses which may be suffered or incurred by the NPCI and that the NPCI compels RBL Bank to pay, which must arise out of or in connection with the following events, solely to the extent that such events are directly caused by the acts or omissions of the Customer(s) in connection with the use of the UPI Facility.
- The Customer(s) further agree to promptly pay RBL Bank and/or its affiliates such amounts as may be reasonably determined by RBL Bank and/or its affiliates to be necessary to indemnify and hold them harmless against any such losses, liabilities, or expenses, whether actual or contingent in nature.
- The Customer(s) also agree to bear all costs, damages, and expenses, including but not limited to reasonable legal fees and court costs, incurred by or awarded against RBL Bank and/or its affiliates in connection with any such claim, suit, action, or proceeding arising from the Customer(s)’ use of the UPI Facility.
11. Confidentiality and Disclosure:
To the extent not prohibited by applicable law, the RBL Bank shall be entitled to transfer any information relating to the Customer(s) and/or any other information given by the Customer(s) for utilization of the UPI Facility to and between its branches, representative offices, affiliates, representatives, auditors and third parties selected by RBL Bank, wherever situated, for confidential use in and in connection with the UPI Facility. Further, RBL Bank shall be entitled at any time to disclose any and all information concerning the Customer(s) within the knowledge and possession of RBL Bank to any other bank/association/financial institution or any other body. This clause will survive the termination of this agreement.
12. Termination:
RBL Bank may, at its discretion, withdraw temporarily or terminate the UPI Facility, either wholly or in part, at any time without giving prior notice to the Customer(s). RBL Bank may, without prior notice, suspend the UPI Facility at any time during which any maintenance work or repair is required to be carried out or in case of any emergency or for security reasons, which require the suspension of the UPI Facility. The closure of the Account of the Customer(s) will automatically terminate the UPI Facility. RBL Bank may suspend or terminate the UPI Facility without prior notice if the Customer(s) has breached these T&Cs or RBL Bank learns of the death, bankruptcy or lack of legal capacity of the Customer(s). Except as otherwise provided by the Applicable Laws or regulation, RBL Bank reserves the right to terminate the UPI Facility and/or expand, reduce or suspend the transactions allowed using this UPI Facility, change the process and transaction limits associated with this UPI Facility based on security issues, at any time, without any prior notice to the Customer(s).
13. Proprietary Rights:
The Customer acknowledges that all property rights shall at all times belong to RBL Bank or the relevant third-party vendors, advertisers, affiliates, where applicable. The Customer shall not attempt or reproduce, copy, transmit, publish, perform, broadcast, adapt, store, distribute, display, license, alter and/or hyperlink the property rights without RBL Bank’s prior written consent.
14. Modification/ Alterations to the UPI Facility:
RBL Bank reserves the absolute discretionary right to make any amendments in the given terms and conditions at any time as it may deem fit without any prior notice to the Customer(s). Any such amendment shall be communicated to the Customer(s) by displaying on the Website and the Customer(s) shall be bound by such amended T&Cs.
C. Additional Terms and Conditions for SMS Banking:
1. Definitions:
- “Access Providers” shall mean any cellular mobile telephone service provider and unified access service provider having a license as per Section 4 of the Indian Telegraph Act, 1885 with whom the Customer has entered into an independent contract with for availing telecom services including SMS.
- “Device” shall mean a mobile phone that enables the Customer(s) to use the SMS Banking Service(s), together with the requisite accessories, equipment attachments and other software including SIM card linked to the Registered Customer Number.
- “One Way Communication” shall mean the Service provided by RBL Bank to the Customer(s) on SMS where RBL sends its Customer(s) one-way message(s) through its Registered Bank Number in the nature of information, alerts, updates, transaction alerts in relation to the Customer(s) Account and such other communication(s) as RBL Bank may enable from time to time, at its discretion.
- “Registered Bank Number” shall mean the authorized number of RBL Bank which is designated for the purposes of providing SMS Banking Service(s) as prescribed by RBL Bank from time to time.
- “Registered Customer Number” is the mobile number which the Customer(s) has registered with RBL Bank.
- “SMS Banking Service(s)” shall mean RBL Bank’s facility of SMS banking under MyBank which provides the Customer(s) service(s) such as information relating to the Account(s) of the Customer(s), details about transactions, utility payment, funds transfer and such other services as may be provided on the Customer's Device using SMS by RBL Bank from time to time.
- “Two Way Communication” shall mean the service provided by RBL Bank to the Customer(s) on SMS where the Customer(s) can communicate with RBL Bank by sending messages to Registered Bank Number, which may be in the form of requests, seeking information, asking queries etc. However, RBL Bank’s responses shall be limited only to such queries, information, requests as may be determined by the Bank from time to time, at its sole discretion.
2. Interpretation:
- All references to singular include plural and vice versa and the word "includes" should be construed as "without limitation".
- Words importing any gender include the other gender.
- All headings, bold typing, and italics (if any) have been inserted for convenience of reference only and do not define limit or affect the meaning or interpretation of these T&Cs.
- Reference to any law or legislation, regulation, rule shall mean, applicable, constitution, statute, law, rule, regulation, ordinance, judgment, order, decree, authorisation, or any published directive, guideline, notice, requirement or governmental restriction, having the force of law in any jurisdiction and include laws as amended from time to time.
3. Eligibility of Using SMS Banking Service(s):
- The Customer(s) hereby agrees and undertakes that the Customer(s) shall use the SMS Banking Service(s) only if the Customer(s) fulfils the eligibility as given below:
- The Customer is an individual;
- The Customer is a major;
- The Customer is of sound mind, solvent and competent to contract;
- The Customer is a resident of India and is present within the territory of India at the time of availing of the SMS Banking Service(s);
- The Customer is the Account holder and is the sole signatory or is authorised to act independently.
- Customer(s) who are joint account holders, shall be required to obtain a written mandate from other account holders authorising RBL Bank to provide the SMS Banking Service(s) to the Customer(s).
- An account in name of the minor, in which the minor is a joint account holder, is not eligible for availing SMS Banking Service(s).
4. Registration and Customer(s) Authentication:
The Customer(s) hereby agrees that by completing the registration process prescribed by RBL Bank for the SMS Banking Service(s) and by agreeing to these T&Cs, the Customer agrees to avail of the SMS Banking Service(s) in the form of One-Way Communication, Two-Way Communication from RBL Bank. The Customer(s) hereby agrees that the Customer(s) grants express authority to RBL Bank for carrying out the RBL Banking Service(s) requested by the Customer(s) on SMS on its Registered Bank Number. The Customer also agrees that for any communication made to the Registered Bank Number, RBL Bank shall have no obligation to authenticate the identity of the Customer for providing the SMS Banking Service(s) once the registration for the SMS Banking Service(s) is complete or once it receives any request/ communication to its Registered Bank Number. Further, for any communication made using the Registered Customer Number, it shall be deemed that it is the Customer itself and not any other person who is interacting with RBL Bank. If the Registered Customer Number is linked to more than one Account with RBL Bank, RBL Bank shall give the option to the Customer to choose the Account in relation to which the Customer seeks to avail of the SMS Banking Service(s).
5. Acceptance and Binding Nature of the T&Cs:
- The Customer agrees that by availing of the SMS Banking Services, by sending any communication/ message to the Registered Bank Number by SMS and/or by completing the registration process as provided for hereunder, the Customer shall be deemed to have read, understood and accepted and agreed to all these T&Cs and such T&Cs shall be binding on the Customer in the same manner as if the Customer has agreed to the same in writing. RBL Bank's own record or log of transactions maintained through computer systems or otherwise shall be accepted as conclusive and binding for all purposes.
- By completing the registration process and accepting these T&Cs, the Customer agrees to receive notifications/ alerts/ acknowledgements/ updates via SMS on their Registered Customer Number with RBL Bank including information in relation to the Account, transaction details, value added subscriptions, transaction alert notifications, regulatory updates, personalized offers, new product features etc.
6. Joint Account Holder(s):
The Customer hereby agrees that if the Account of the Customer is a joint holder account, then the SMS Banking Service(s) shall be available only to the Registered Customer Number of the primary account holder of the joint account and the secondary account holder shall not be able to avail of the SMS Banking Services. The Customer hereby agrees that it has obtained the necessary authorisation and consent from the secondary account holder, if required, for the purpose of availing the SMS Banking Services.
7. Important:
The Customer(s) unconditionally and irrevocably agrees to the following:
- Both One Way Communication and Two-Way Communication shall at all times be governed by and subject to these T&Cs.
- That the SMS Banking Service(s) provided to the Customer(s) are subject to Applicable Law(s) rules, regulations, notifications, circulars and guidelines introduced or amended from time to time by any regulatory/ statutory/ governmental authority in India.
- The Customer(s) shall provide RBL Bank with such information, instructions and/or assistance in the manner and form required by RBL Bank for provision of SMS Banking Service(s).
- RBL Bank reserves the right to remove or otherwise delete any content or submissions made by the Customer(s) that violates RBL Bank’s internal rules or which are inappropriate and against the moral turpitude, as per RBL Bank’s sole discretion, without undertaking any liability in relation to the same or giving any prior warning to the Customer(s).
- The Customer(s) also agrees to receive notifications including Account and transaction alert notifications, regulatory updates, personalized offers, new product features etc. on the mobile number registered with RBL Bank.
- The Customer(s) is aware that it may not be possible for RBL Bank to give detailed information on the SMS Banking Service(s) functionalities. RBL Bank shall not be responsible or liable to the Customer(s) or any third party for the consequences arising out of or in connection with using of this SMS Banking Service(s).
- The Customer(s) is aware that authentication technologies and strict security measures are required of the Customer(s) for using SMS Banking Service(s) on the Device.
- The Customer(s) undertakes to ensure that the Customer(s) shall not reveal his/her communication exchanged between the Customer(s) and RBL Bank and be solely responsible for all such conversations while utilizing SMS Banking Service(s).
- The Customer(s) understands that their Device is vulnerable to various threats including but not limited to:
- unauthorized access by intruders to the data/information contained on such Device.
- identity theft.
- privacy violations;
- planting of stealth software, malware, viruses etc;
- disablement or distortion of operations;
- interception of the transmission of encrypted data/message etc;
- The Customer shall immediately notify RBL Bank in writing if Customer is suspicious of any unauthorized access. RBL Bank shall not be responsible or liable to the Customer(s) or any third party for the consequences arising out of or in connection with using of this Service(s). The Customer(s) shall immediately opt-out of the SMS Banking Services by de-registering for the SMS Banking Service(s).
- The Customer(s) shall ensure appropriate network connection and the receipt of messages by the Customer(s) shall be subject to the network connection and RBL Bank shall not be held responsible and liable for any delay, suspension, interruption or non-receipt of the responses from RBL Bank.
- The Customer(s) is aware that using the application on their Device involves many uncertain factors and complex software, hardware, systems, etc. which are susceptible to interruptions and dislocations. RBL Bank does not make any representation or warranty that SMS Banking Services will be available at all times without any interruption, delay or suspension and that RBL Bank shall not be responsible and liable for any variation, reduction or imposition of the terms or the Customer(s) inability to use SMS Banking Service(s) for any reason whatsoever.
- The Customer(s) agrees that the Customer shall not have any claim against RBL Bank on account of any suspension, interruption, non-availability or malfunctioning of SMS Banking Service(s) due to system failure at RBL Bank’s end for any reason thereof.
- RBL Bank reserves the right to revise the policies, features and benefits offered through the Facility from time to time and may notify the Customer of any such revisions/changes in any manner as deemed appropriate. The Customer will be bound by such revisions/changes unless the Customer terminates the Facility.
- The Customer(s) is responsible for maintain the security and safeguarding of the Customer(s) SIM card linked to the Registered Customer Number and the Device(s) on which such SIM card is used.
- The Customer irrevocably and unconditionally authorizes RBL Bank to access all his Account(s) for effecting banking or other transactions for the service requests received through SMS Banking Service(s) and to share the Account(s) information (in masked format) with any third parties for the purpose of accepting/ executing such requests of the Customer.
- It is understood by the Customer(s) that the Registered Bank Number cannot be utilised for the purpose of grievance redressal or reporting fraud as of now. It will not be the responsibility of the Bank to act upon such incidents received through SMS.
8. Consent for SMS Banking Service(s) and sharing Personal Information:
- The Customer hereby agrees and consents to RBL Bank for providing the SMS Banking Service(s) through SMS as a medium.
- The Customer further agrees that any consent in relation to the Services given by the Customer to the Bank Registered Number shall be binding on the Customer.
- The Customer hereby expressly agrees and consents to RBL Bank for sharing and/or displaying Customer information including Account number (in masked form or otherwise), name of the Customer, type of Account, Account balance, summary of transactions including information which may constitute as sensitive Personal Information, on SMS as may be necessary for provision of the SMS Banking Service(s).
- The Customer hereby acknowledges and understands that by agreeing to availing the SMS Banking Service(s), the Access Provider and its representatives may have access to the Customer(s) SMS and content therein including the SMS communications exchanged between the Customer with RBL Bank in the course of availing the SMS Banking Service(s).
9. Information not to be Shared:
- The Customer hereby agrees that it shall not submit or transmit any content or information to the Registered Bank Number through SMS Banking Service(s):
- Personal Information such as name, address, phone number, gender, account balance, financial details, passwords of the Customer or of any other person;
- Which is obscene, vulgar, or pornographic, immoral, illegal, illicit, unethical, antisocial etc;
- Encourages the commission of a crime or violation of any law or violates any Applicable Law(s);
- Infringes the intellectual or copyrights of a third party; and/or
- Constitutes confidential information.
- RBL Bank reserves the right to remove or otherwise delete any content or submissions made by the Customer that violates RBL Bank’s internal rules or which are inappropriate, as per RBL Bank’s sole discretion, without undertaking any liability in relation to the same or giving any reasons or prior warning to the Customer.
10. Authorisation:
- The Customer(s) irrevocably and unconditionally authorizes RBL Bank to access the Customer(s)’ Account registered for SMS Banking Service(s) for giving effect to the transactions of the Customer(s) through SMS Banking Service(s).
- The Customer(s) expressly grants authority to RBL Bank to record the transaction details of the Customer(s). All records pertaining to any transaction which may be generated by RBL Bank arising out of the use of SMS Banking Service(s), including the time the transaction recorded shall be conclusive proof of the genuineness and accuracy of the transactions.
- The Customer(s) authorised RBL Bank to send any rejection message, if it finds that the request sent by the Customer(s) is not as per RBL Bank’s format.
11. Software and Hardware:
- RBL Bank may advise and/ or inform the Customer(s) from time to time regarding the internet software, such as browsers, which are necessary for availing SMS Banking Service(s).
- RBL Bank shall have no obligation to provide compatible versions of its software platform suitable to the system, included but not limited to computer hardware, operation systems, software to the Customer(s).
- RBL Bank shall be under no obligation to support all the versions of these internet software.
- It is the sole responsibility of the Customer(s) to upgrade their software, hardware, operating browser system etc. to avail the SMS Banking Service(s) at their own costs from time to time and make their system compatible to access the SMS Banking Service(s).
- The Customer is aware that using any mobile application involves many uncertain factors and complex software, hardware, systems, etc. which are susceptible to interruptions and dislocations. RBL Bank does not make any representation or warranty that SMS Banking Service(s) will be available at all times without any interruption and that RBL Bank shall not be responsible for any variation, reduction or imposition of the terms or the Customer’s inability to use the SMS Banking Services for any reason whatsoever.
12. Internet Frauds:
- The internet is susceptible to a number of frauds, misuse, hacking, phishing and other actions which could threaten the security of the information available to the Customer(s) while availing the SMS Banking Service(s). While RBL Bank shall aim to provide security to prevent the same, it cannot guarantee any safeguard from such internet frauds, hacking, phishing and other actions which could affect the Customer(s) while availing SMS Banking Service(s). The Customer(s) shall separately evaluate all risks arising out of the same and RBL Bank under no circumstance shall be held responsible for any losses suffered by the Customer(s) as a result of such internet frauds.
- The Customer understands that using SMS may carry extra risks. Further, any message and information exchanged on SMS shall be subject to the risk of being read, interrupted, intercepted, or defrauded by third party or otherwise subject to manipulation by third party or involve delay in transmission. RBL Bank shall not be responsible or liable to the Customer(s) or any third party for the consequences arising out of or in connection with using of SMS Banking Service(s).
13. Technology Risks:
The technology for enabling the SMS Banking Service(s) offered by RBL Bank could be affected by ransomware, virus or other malicious, destructive or corrupting code, programme or macro or any other security threat. It may also be possible that the site of RBL Bank may require maintenance and during such time it may not be possible to process the request of the Customer(s). This could result in delays in the processing of instructions or failure in the processing of instructions or requests and other such failures and inability. The Customer(s) understands that RBL Bank disclaims all and any liability, whether direct or indirect, whether arising out of loss of profit or otherwise arising out of any failure or inability by RBL Bank to honour any Customer(s) instruction for whatsoever reason. The Customer(s) unequivocally and unconditionally understands and accepts that RBL Bank shall not be responsible for any of the aforesaid risks. The Customer also accepts that the Bank shall disclaim all liability in respect of the said risks.
14. Mistakes and Errors:
For availing SMS Banking Service(s), RBL Bank would require proper, accurate and complete details to be provided by the Customer(s). For instance, the Customer is aware that he/she would be required to fill in the requisite details of the account with regard to which he/she seeks to obtain the account balance. In the event of any inaccuracy in this regard, the Customer(s) acknowledges that the Customer may be sent responses or shown information which may not be applicable to them or may not be sent a satisfactory response, and the Customer(s) agrees that in such a scenario RBL Bank shall not be liable for any loss to the Customer(s) in this regard. The Customer(s) shall therefore take all care to ensure that there are no mistakes and errors and that the request made/ query asked by the Customer(s) to RBL Bank in this regard is error free, accurate, proper and complete at all points of time. The Customer(s) agrees that RBL Bank is providing the SMS Banking Services at the Customer(s) sole risk. The Customer(s) agrees that RBL Bank shall not be liable for any loss, damages or consequences whatsoever arising due to any erroneous or incomplete information or any delay in executing the instructions for reasons beyond the control of RBL Bank. The Customer(s) shall be liable and responsible to RBL Bank and accede to accept RBL Bank's instructions without questions for any unfair or unjust gain obtained by the Customer(s) in the course of availing of the SMS Banking Service(s).
15. Misuse of Password:
The Customer(s) acknowledges that if any third person obtains access to the Customer's Device or SIM card or the Customer’s SIM, such third party may be in a position to access Customer information including Account related information of the Customer, which may be confidential in nature such as account balance, mini bank statements, etc. of the Customer. The Customer shall at all times ensure that the T&Cs applicable to the use of the password and security of SIM and the Device of the Customer(s) are strictly complied with at all times.
16. Proprietary Rights:
- The Customer acknowledges that the software underlying the SMS Banking Service(s) as well as other internet related software which are required for accessing SMS Banking Service(s) is the legal property of RBL Bank /respective service providers. The permission given by RBL Bank to access SMS Banking Service(s) will not convey any proprietary or ownership rights in the above software.
- The Customer shall not attempt to modify, translate, disassemble, decompile, or reverse engineer the software underlying SMS Banking Service(s) or create any derivative product based on the software.
- The Customer shall not reproduce, copy or redistribute for commercial purpose any materials or design elements of SMS Banking Service(s) hereunder.
17. Customer Information:
- The Customer understands and agrees that while RBL Bank has deployed processes and technology to prevent unauthorized use or accidental disclosure of the Customer Information or any other data pertaining to the Customer on SMS, the Customer understands and accepts that by using the SMS Banking Service(s), the Customer Information and any other data of the Customer in relation to the Services may also be stored on the application/ server of the Access Provider , which are outside of the control of RBL Bank and RBL Bank cannot guarantee the security of the Customer Information or any other data which is stored on therein.
- The Customer(s) unconditionally and irrevocably agrees and accepts that RBL Bank is not responsible for any compromise in such Customer Information and acknowledges that the Customer(s) is providing the Customer Information at their own free will and risk.
- The Customer(s) hereby expressly consents to and authorises RBL Bank (whether acting by itself or through any of its service providers, and whether in automated manner or otherwise), to do and undertake any of the following, in relation to the Customer Information as may be deemed relevant by the Bank for its purposes:
- to collect the Customer Information and other physical or online sources including SMS accessing the same from credit information companies, to get the authenticity, correctness, adequacy, etc. of the Customer Information verified from any sources and persons including from online data bases; and to act for and on Customer(s)’ behalf for such accessing, collecting or verifying of the Customer Information including using Customer’s log in and password credentials on the online platforms; such collection, access and verification may be done without any notice to the Customer(s);
- process Customer Information in a manner including but not limited to by way of storing, structuring, organising, reproducing, copying, using, profiling, as may be deemed fit by RBL Bank;
- retain Customer Information for such period as may be required for by applicable laws and regulations or for Bank’s evidential and claims purposes, whichever is longer;
- to share and disclose the Customer Information to service providers, credit information companies, regulators, investigating agencies, judicial, quasi-judicial and statutory authorities, or to other persons as may be necessary in connection with the contractual or legal requirements or in the legitimate interests of RBL Bank or as per the consent;
- any of the aforesaid may be exercised by RBL Bank for the purposes mentioned above, for the purposes of credit appraisal, fraud detection, anti-money laundering obligations, for entering into contract, for direct marketing , for developing credit scoring models and business strategies, for monitoring, for evaluating and improving the quality of services and products, for other legitimate purposes or for any purposes with consent.
- The Customer(s) understands and acknowledges that RBL Bank has engaged/ may engage a service provider from time to time, for various aspects including but not limited to services, storage, software/ hardware requirements, processing of requests, engines and has no objection to the same. The Customer hereby confirms that all the authorisations and rights in any of 17(c) (i) to 17 (c) (v) above also extend to and are given above to the service providers of RBL Bank, including for all the sharing and disclosures amongst RBL Bank and its service providers.
- The Customer(s) hereby expressly agrees to RBL Bank and/or its affiliates for using the Customer Information and for cross-selling to them various products and services of RBL Bank from time to time.
18. Security Measures:
- The Customer(s) hereby unconditionally and irrevocably understands and agrees that the Customer(s) must:
- keep the passwords to their Device strictly confidential and shall under no circumstance reveal any of the password(s) to any other person;
- commit the password to memory and not record any of them in a written or electronic form;
- not let any unauthorized person have access to their Device or leave their Device unattended
- put in place a passcode or password or PIN or a security key of similar nature to lock/ restrict access to their Device and secure it from any unauthorized access and not share such passcode/ password/ PIN/ security key with any other person;
- take adequate precautions from any ransomware, malware, virus or any other security threat from entering the Device, including installing adequate anti-virus protection.
- The Customer(s) hereby agrees and accepts that he/she shall at all times be solely responsible for the protection and safe keep of his SIM card, Device and the applications installed thereon, , login ids, Customer Information, security details and passwords as mentioned hereinabove and hereby fully agrees that RBL Bank shall in no manner be liable for any direct, indirect, consequential or any other loss occurring on out of any action or omission on part of the Customer(s). The Customer(s) also agrees that he/she understands the risks of losing his SIM card or transferring his SIM card to another Device.
- The Customer(s) also agrees and accepts that any person having access to any such Device of the Customer or if RBL Bank receives instructions from the Registered Customer(s)’ Number, it shall be deemed to duly authorised by the Customer(s) and acting for and on behalf of the Customer, with the authority and intention to bind the Customer(s) irrevocably with any actions pursuant thereto including the acceptance of these T&Cs, vis-à-vis RBL Bank.
19. Liability:
- The Customer agrees that the Customer(s) shall be liable for all loss from unauthorized uses of his SMS and/or for requests made while availing the SMS Banking Service(s) and/or for any breach(es) of these T&Cs, or if the Customer(s) has in any way contributed or caused the loss by negligent actions including the following:
- Keeping a written or electronic record of the Customer’s Device password;
- Losing the SIM card;
- Transferring the SIM card to another device;
- Not advising RBL Bank within a reasonable time about unauthorized access to or erroneous transactions/ use of SMS Banking Service(s) on the Device/ SIM card/ SMS;
- Any unauthorized access or use of the Customer(s) SMS Banking Service(s) and failing to notify RBL Bank within a reasonable time of any unauthorized access, erroneous transactions, or misuse of the SMS Banking Services via the Customer’s device, SIM card, or SMS.
- RBL Bank shall not be responsible or liable to the Customer or any third party for the consequences arising out of or in connection with using of this SMS Banking Service(s), including for any reasons aforesaid and the entire liability and responsibility due to any of the aforesaid shall completely be on the Customer(s) above.
- The Customer(s) agrees that RBL Bank shall under no circumstance be held liable to the Customer(s) if the Service(s) or if the Customer(s) is unable to register for the SMS Banking Service(s) in the desired manner for reasons including but not limited to natural disasters, legal restraints, faults in the telecommunication, internet or network failure, software or hardware error or any other reason beyond the control of RBL Bank.
- Under no circumstances shall RBL Bank be liable for any form of damages, whether direct, indirect, incidental, consequential, or special, including but not limited to loss of revenue, profits, goodwill, business interruption, or any other commercial or economic loss, whether sustained by the Customer or any third party, arising from the use or inability to use the SMS Banking Service(s).
- RBL Bank shall not be liable for any damages, losses (direct or indirect) whatsoever, due to disruption or non-availability of any of the SMS Banking Service(s) due to technical fault/ error or any failure in telecommunication network or any error in any software or hardware systems.
20. Indemnity:
- The Customer(s) undertakes to indemnify and hold harmless RBL Bank and its directors, representatives, officers, agents, employees, and/or affiliates against losses, damages, expenses, actions, claims, demands and proceedings whatsoever, that RBL Bank may incur, sustain, suffer or be put to at any time as a consequence of action or inaction upon any instructions given by the Customer(s) or otherwise for use of the SMS Banking Service(s).
- Without limiting the generality of the foregoing, the Customer(s) specifically agrees to indemnify and hold harmless RBL Bank from any losses, damages, or liabilities arising out of or related to the following circumstances:
- the Customer(s) permitting any third parties to use the Device and/or avail SMS Banking Service(s).
- the Customer(s) permitting any other person to have access to his/ her Device or as a consequence of leaving the Device unattended or loss of Device and RBL Bank acting/not acting on any instructions received from the same.
- the Customer having breached these T&Cs.
21. Termination of SMS Banking Service(s):
RBL Bank shall be entitled to withdraw/ discontinue/suspend/ disallow the use of any of the SMS Banking Service(s) at any time at its sole and absolute discretion without need for any permission from or notice to the Customer(s). RBL Bank may also discontinue or suspend or terminate SMS Banking Service(s) without prior notice if these T&Cs are breached. The closure of all Account(s) by the Customer(s) will automatically terminate the SMS Banking Service(s). RBL Bank may withdraw or terminate SMS Banking Service(s) anytime either entirely if RBL Bank learns of the death, bankruptcy, or legal incapacity of the Customer.
22. De-registration of SMS Banking Service(s):
The Customer(s) may request for de-registration of SMS Banking Service(s) by sending an SMS to the Registered Bank Number as per the process specified by RBL Bank in this regard. RBL Bank may also enable other additional modes for de-registration from time to time. Once the de-registration process is complete, RBL Bank will no longer process the Customer(s) information for the purpose(s) originally agreed to by it, unless RBL Bank has another legitimate basis for doing so in law in accordance with the Privacy Policy or any other consent/ contract with the Customer, however, the Customer understands that for the de-registration may not be immediate and may take some time for the same to come into effect. RBL Bank reserves the right to change the aforementioned process of de-registration. The Customer(s) agrees that the Customer(s) will remain responsible for any requests made/ messages sent to RBL Bank using SMS Banking Service(s) prior to the time such cancellation of SMS Banking Service(s) is effected by RBL Bank.
23. Independent Relationship with Access Provider:
The Customer hereby agrees that the Customer has an independent relationship with the Access Provider for the telecom services including availing of the SMS services and RBL Bank shall not be held liable for any issues, complaint, disputes and/or grievances which the Customer may have with the Access Provider which is not in relation to the SMS Banking Services of RBL Bank and RBL Bank shall not be made party to such disputes with the Access Provider. RBL Bank is not responsible for the privacy or security policies of the Access Provider and any other entity that may be linked to/ from/ within it, and does not assume liability for any damage incurred by the Customer from the use of the said telecom services including SMS. The Customer fully understands that RBL Bank is not endorsing the products or services of the Access Provider or of any advertisement etc. appearing thereon. The use of SMS service from the Access Provider shall be an independent arrangement between the Customer and the Access Provider and the Customer shall independently be guided by the privacy policies and terms of use of the Access Provider for the same and RBL Bank shall not be party to the same nor shall have any concern with the same. Further, while RBL Bank does not levy any fees/ charges on the SMS Banking Service(s), since the SMS Banking Service(s) are being/ will be availed by the Customer by way of SMS sent through the Access Provider, the Access Provider may levy certain fees and/or charges on the use of the SMS Banking Service(s) by the Customer as per the independent arrangement and terms and conditions/ subscription plan between the Customer and the Access Provider and the Customer shall be solely liable to pay all such fees and/or charges.
D. Additional Terms and Conditions for the use of RBL Bank’s Biometrics Service:
1. Definitions:
- “Biometric Services” shall mean the process of verifying biometric credentials, including but not limited to fingerprints, facial recognition, or any other biometric data as RBL Bank may make available in consonance with these T&Cs.
- “Permitted Mobile Device” shall mean compatible android mobile device or iOS mobile device running an operating system as specified by RBL Bank from time to time, or any other electronic device devices or equipment which RBL Bank may stipulate for using Biometric Services from time to time.
2. Important:
- The Biometric Services provide an alternative to using MPIN to verify the Customers identity for accessing RBL Bank mobile banking services via the Application. Customer can register their Permitted Mobile Device, (with biometric identity sensor) for the Biometric Services.
- Once the Customer is successfully registered, Customer may utilise their biometric credentials to confirm their identity for accessing RBL Bank’s mobile banking services. Even though the Customer has registered for the Biometric Services, the Customer may still choose to access the RBL Bank mobile banking services via the Application by using the Customer’s personal mobile banking Customer identification and MPIN.
- The Customer acknowledge and agree that to use the Biometrics Service, the Customer must:
- be a valid Customer of RBL Bank’s mobile banking services.
- install RBL’s Application using a Permitted Mobile Device.
- activate the biometrics recognition function on the Customer’s Permitted Mobile Device and register at least one of the Customer’s biometrics as may be specified by RBL Bank from time to time to control access the Permitted Mobile Device.
- confirm and authorise RBL Bank to verify Customer’s identity by biometric credentials registered by the Customer on their Permitted Mobile Device instead of RBL Bank’s Mobile Application personal Customer identification and MPIN/ PIN.
- must ensure that only the Customer’s biometrics are stored on their Permitted Mobile Device to access the device and understand that any biometrics that is stored on their Permitted Mobile Device can be used to access mobile banking services including access to the Customer’s accounts; and
- ensure the security of the security codes as well as the password or code used to register the Customer’s biometrics on the Permitted Mobile Device.
- The Customer(s) acknowledge that the authentication is performed by the mobile application by interfacing with the fingerprint authentication module on the Permitted Mobile Device and that the Customer(s) agrees to the authentication process.
- In an event the Customer registers any third party(s)’s fingerprints in their Permitted Mobile Device or any third party(s)’s face with the Application by way of registration, the third party(s) will be able to access RBL Bank’s Application to which RBL Bank will not be held responsible whatsoever for such access or any losses or damages incurred by RBL Bank as a result of such access authorised by the Customer.
- All the instructions received by RBL Bank with the Customer’s identify verified through Biometric Services shall be binding on the Customers. The Customer shall be liable for all such instructions and all resulting transactions in accordance with the provisions of all RBL Bank’s Terms and Conditions.
- Once a Permitted Mobile Device of the Customer has been registered for the Biometric Services in respect of the Customer’s RBL Bank’s mobile banking services, information about the Customer’s mobile banking can be accessed using the Biometric credentials. RBL Bank owes no duty to verify that the relevant biometric credentials are that of the Customers. All the use and access of RBL Bank’s mobile banking services referring to any biometric credentials (whether such access has been authorised by the Customer or not) shall be deemed to be use of RBL Bank’s mobile banking services by the Customer.
- The Customer can deactivate the RBL Bank’s Biometrics Services at any time using the option provided for the same within the mobile banking services.
- In an event the Customer informs RBL Bank that the security of the Customer’s biometric credentials or other security code has been compromised, RBL Bank may require the Customer to change the security code, re-register the Customer’s biometric credentials or cease the use of the RBL Bank’s Biometrics Services.
- The Customer acknowledges and agrees that, for the purposes of the RBL Bank’s Biometrics Services, the mobile application will be accessing the biometrics credentials registered in the Customer’s Permitted Mobile Device, and the Customer hereby consents to RBL Bank accessing and using such information for the provision of the RBL Biometric Services.
- The Customer understands the need to protect their Permitted Mobile Device and shall be responsible for all use of their Permitted Mobile Device (whether authorised by the Customer or otherwise) to access the RBL Biometrics Services.
- The Customer further understands and agrees that:
- the authentication of the biometric credentials of the Permitted Mobile Device is not provided by RBL Bank. RBL Bank makes no representation or warranty as to the security of the biometrics authentication function of any Permitted Mobile Device and whether it works in the way that the manufacturer of the device represents.
- RBL Bank does not represent or warrant that the RBL Bank’s Biometrics Services will be always accessible, or function with any electronic equipment, software, infrastructure, or other electronic banking services that may be offered by RBL Bank from time to time.
- RBL Bank is not liable for any loss incurred by the Customer in connection with the use or attempted use of the RBL Biometrics Services, or instructions, or any unauthorized transactions through or in connection with the RBL Bank’s Biometrics Services.
- The Customer shall indemnify RBL Bank from any and all loss and damage which RBL Bank may incur in connection with any improper use of the RBL Bank’s Biometrics Services.
- Under no circumstances is RBL Bank liable for any indirect, special, incidental, consequential, punitive or exemplary loss or damages, including without limitation loss of profits, loss due to business interruption or loss of any program or data in the Customer’s Permitted Mobile Device.
- Biometrics ID, enables biometric access for all biometrics enabled on the device. The Customer(s) are advised to disable the biometrics of any other person on the device and proceed.
